Not without you there to fill it out, I thought that was clear.Well now, he could have ran this check and saved me the trip.
That reverses the sequence. FIRST you fill out the form. THEN the bg check is ran.joanie said:If I passed the check, then I could have went and filled out the form.
No, you would only be in a 'world of U no What' if you are actually a prohibited person. Frankly, the FFL needs NO real reason to refuse to sell to you. If you came across to him, as you appear here, I would not be surprised at all if he simply said 'you failed the bg check' to get you out of his shop.joanie said:In any case I had the items in question removed from here. most will be sold, a couple will be saved, but for now, I'm no longer a threat. I am no longer in possesion of them, rejoice. Maybe this is a blessing in desiguse, If I had been stopped open carrying, and this came up, I'd be in a world of U no What.
...he simply said 'you failed the bg check' to get you out of his shop.
Lying about the bg check? Possibly.Wouldn't that be illegal?
hyperbole? what making up words now?
What "working on getting it"??? Just ask. Tell him you are appealing the deny. If he refuses to tell you (unless he is a total moron, he won't), tell him that you will inform the FBI and the ATF that he is illegally withholding the number. He won't risk his FFL by not following the procedures. You'll get the number. It ain't a State secret.
I did, I called, I asked. He is busy, he is off on some errand, he can't be bothered with it right now. I thought I mentioned that. But If he feels like messing with it, he might get back with me on Wednsday. What should I expect of someone who lied to me about selling me the item? Also, I did talk to an attorney breifly, will again next week. I don't know what this seller's sick game is, but I think maybe others should be warned of his scam.
Nope. Not required. The transferee has to be there in person to fill out the 4473. He doesn't have to be there when the check is run. Most FFLs use computers to do the NICS check, which truly is "instant," so the transferee is usually right there, but does not have to be. I only have to have the 4473 with the transferee's answers and his signature in front of me when I run the NICS check, not the transferee himself. .

How so? Being denied is not the same thing as being a felon in possession. It just means you were denied. Christ if I hid and sold my guns every time I was delayed it would be like playing musical chairs. A dealer cannot sell if you are denied, they also cannot sell a handgun to a anyone younger than 21, BUT it does not mean that anyone under 21 cannot own a firearm. If you know for sure you are not allowed firearms then by all means find somebody to hold them until the mess is cleared up. But if you are just going on what ONE dealer said, you are acting foolish.
Awww there is a bit of information we did not know. So this transaction was from a online auction that the seller wanted to back out on. The first thing you should do is get a brick and mortar dealer to run a BG on you. There can be many reasons why a dealer would want to back out of a deal, BUT on a online auction site they face sanctions by the site for such behavior without good reason. That would explain his refusal to give you the number. You may have gone off the deep end for something that is common on auction sites.Maybe, but am I out of line to be upset and angry about this? No I don't know for sure, it's frustrating that no one else seems to know, or is not willing to tell me. It's not so much breaking the law that concerns me, I don't hold all laws as sacret the way some do, it's not knowing if I am or not that I can be prepaired. Maybe wednsday I can get some answers along with that transaction number.
It's cool though. I may not know where I stand in one area, but I learned real fast where I stand in another. For every seller's BBL I make it on, theres always 1,000 others who will gladly take my cash. This seller is just getting the gas stations rich with his lies, he should be getting kickbacks from them.

trollI did try to report it, they wouldn't take my report. 1-877-324-6427 www.fbi.gov/NICS 614-827-8470 ...
This was not an auction, it was a listing on a online classifids.
I can not fix the problem without the transaction number, and the seller is not giving it. I was told I have to drive another 200 miles to get the number in person. Throwing good money after bad. He is not required to give me the transaction number over the phone. So there you go, I didn't pass the check and I have no possible way of knowing why.
But I'm out of line, and it's my fault somehow according to some on this board. Because these NICS back ground checks are a wonderfull thing that really does work to keep guns out of the hands of criminals, because no criminal, murderer, or bank robber would ever buy or steal a gun without going through these proper channels. And the sheriffs are a wonderfull bunch who would never lie and abuse their power.
These replys are sickining.

There WAS more to the story.
Recommend a thread closure or lock. This is full of half-truths and deliberate withholding of pertinent facts. A private seller has the right to deny the sale. End of story.

1. Is the dealer an FFL?
Yes, it would appear so.
2. Did you fill out a 4473?
I filled out something, not sure what it was, I'll call it a 7734 form
3. Did the dealer run a NICS check?
Yes, it would appear so.
4. Did the dealer say that he got a "deny from the FBI"?
I didn't pass the check, It was delayed, same thing.. Seller refused to sell, fine it's hisright, but he still lied over the phone.
5. Have you specifically told the dealer that if he does not give you the NICS number that you will report him to the ATF?
No, I asked nicely for it, said i need it to open an appeal.
6. Have you reported the dealer to the ATF for not giving you the NICS number?
As I said, I tried, but they would not take the report. According to who called me back, I'm supposed to go back there in person to get it.
Now, I am going to flat-out say it. I don't believe you at all.
Well then I'm wasting my time trying to explain it to you. And your not going to believe this. I know why I didn't pass the check. Just figured it out.

If they refuse to tell me why I didn't pass it, this is why, right here.

Theres my answer. Or it's the one I'm giong with since they won't explain why.
Christ's sake! There is a big difference between delayed, and denied! I hate to say but you seem to be intentionally misrepresenting what actually happened. You have done yourself a huge disservice with this thread, I doubt anybody will take your word for anything after this. Did you throw a tantrum with the dealer when you were delayed? Did he trespass you after a outburst? If you are in person as you represent yourself in this thread, no you should not have firearms, IMO.
Or did you make all this up to get people to watch another boring Alex Jones video?
Fine with me, you shouldn't have them also, and now I feel threatened. Locking my doors.
