Shots fired at South Haven Picnic

When I was leaving the Picnic, I got to the vehicle to leave. As I was unloading the gun for transport. I pulled the mag out and stuck it in my pocket, then pulled the slide back to unload the chamber (with ALL fingers UNDER the trigger gaurd), as the breech opened the gun went off. There was no recoil and it sounded like a .22 going off in stead of a .40 cal. It was a springfield XD40. Afterwards, we were pulled over trying to find the state police post (the officer that was in the parking lot had left as we were heading to truck). We were pulled out of the vehicle looking down the barrel of an M16. The LEO that pulled us over beat the hell out of my disabled father and threw his LOADED glock acroos the pavement. Then after we were all detained, they questioned all of us. Then inspected the gun. Ater all was saidand done the LEO was unloading my fathers glock in the trunk of his patrol car with the barrel of the glock pointing at the fender that my buddy was standing by (basically pointing the gun at him while unloading). Then another LEO came flying in asking "I heard it was an XD and I was hoping it was an XDM. I want one of those." Then my gun was released to me and we were allowed to leave. After I took my CPL class and passed, I was informed that the prosecutor had issued a warrant for my arrest. I turned myself in and hired a lawyer.

You have witnesses, your father & buddy, that your fingers were outside of the trigger guard when the gun discharged correct? If the answer is yes, they have no case at all. I would contact Springfield ASAP and let them know about this and see if there are other instances of this happening, if so it will only make their case against you weaker. You say another LEO showed up, if his car was parked behind the patrol car where the LEO was muzzle sweeping your buddy you want to FOIA the video/audio from his cruiser & the video/audio from the LEO that did the original stop. This will make their case even worse if you can show the officer recklessly handling firearms in the presence of civilians, as that is what they are accusing you of doing.

If he's an American citizen he's part of the oc movement, for or against or even neutral. To say we would be better off without them is likesaying we would be better off without any citizen you select.

I've been given misinformation as fact by people in this"movement" that held high position. I know leo's that have had ad's and nd's, oneis even an cpl instructor. As a human being, citizen or not, we all need to choose our words better when we attempt to communicate. I've had some people in this "movement" look down their noses at me as if they were superior. The world is full of different people with different opinions but to single anyone out here because of that is a violation of our first amendment which is the root of our second amendment.

To all who would judge me over an accidental discharge... things happen....get over it and move on. Or kiss my stinker with your tongue flappin', whichever you choose.

FOIA the cruiser video/audio and sue their asses! It's the only way some LEOs can learn the law...by being on the other side of it in court.

Good for you Bigdaddy. I'm glad you won. Now, maybe some of us will learn to NOT jump to conclusions without knowing all the facts.



But I doubt it, unfortunately.
