So I went to the police to get my gun, ccw permit, and license...

They are keeping it as evidence and forwarding to the St. Louis County prosecutor's office because I had a handgun when I had a "fugative" warrant which was bad! Also, my license and CCW permit cannot be released because the guy that does evidence is out of town until next week!

BETTER YET!

A few roads away from the station, the Sgt. Decticve and his parter that just told me all of this BS pulled me over for not using my turn signal! Ha! I always use my turn signal and I might have video evidence of such. Then they were like, you were following to close, and speeding! They let me go with a warning because they were being so nice.

In the morning I talked with the St. Louis County Court Administrator and told her about getting arrested for the bad warrant. She said that was wrong wrong wrong and she was so sorry. She admitted it was their mistake. I have audio of this. They are sending my my bail back and I'm supposed to talk to a county attorney about damages.

That's one professional PD. I guess it was proper for them to keep your weapon in that case, even though the warrant was issued in error. You'll have to get that fixed first, and it sounds like that is in process. I don't know the laws on returning questionably seized property (I call it questionable because there was on RAS to search for warrants, and the warrant was improper anyway), but I would feel fairly sure that they don't get to keep questionably seized property just because someone is on vacation.

You had not mentioned how long you were in Wal-Mart, but I would try to get time stamped video footage of when you went in, and left, and footage in the parking lot to see if the PD was lying in wait. I doubt they're telling you the truth. Maybe they had realized they had screwed up at that point. I'd also FOIA any body mics or car mics.

Enjoy your bonus money from St. Louis City! Sounds like you may need it to fight Maplewood.

Stop it! I was sucking up first! Actually, all I'm for is truth, justice, and the American Way. But, if it requires cities to pay tens of thousands of dollars to get it, that's fine with me :D

Not a lawyer but certain terms have specific meanings, "fugitive warrant" only means that the officers were not from the jurisdiction the warrant was issued from. It would not be a "fugitive" warrant if they had been stl county, more or less just cop talk ti intimidate.

While a past skeptic which we settled, I would highly recommend you re-rig your car, sounds like they might need to be trained. That idiot did not transfer out of velda ridge did he lol!

Yes, I remember our conversations. Thank you for the support in this. I really never expected this type of response. If I had, I probably would have been recording prior to the contact and with something better than a cell phone. I think that other cop is still at Velda City- as a sgt. of course.

That is a pretty large stretch and looks more like "we screwed up, find something" since they may or may not be even allowed to enforce a state law of that nature. "fugitive from justice" is a combo of terms that usually references an out of state criminal charge, not an ordinance violation so unless your speeding was a state violation code it would seem a misuse of terms at the very least, last ticket I got was on I55 by a county and it was a county ordinance violation on the ticket not state.

You NEED to stop talking to the cops and let a lawyer handle it if possible. The firm I PM'd you with, fyi never answers the phone much before 10 am and no one is around on Wed or Fri. They have been around since '69 and handle all sorts of law, federal, state, criminal etc. One of them has his eye on a judge slot and might like a high profile case, you will just have to talk to them and see.

I apologize. Where I said "on RAS" should be "no RAS". That's my fault, I should have proofed better.

Without dispatch tapes, we can't tell much about what the original call was. But we know that we've heard two stories so far, MWAG and traffic infractions. If it's traffic infractions, they might have PC to check warrants (I don't know to be honest.) But, if it's MWAG, that is not a crime, so there's no RAS.

In other news, I picked up my Concealed Carry Qualification from the sheriff today. Tomorrow is the DOR office, and I'm bona fide! It will be nice to be able to wear a coat when I'm open carrying...

The police do not look for traffic warrants, they are secondary to another stop.

The MWG call had them engage and the traffic warrant was secondary to the MWG call arrest.

The arrest fails several criteria, the warrant is a non factor, but it gets fuzzy.

Even if there were traffic infractions, there is still no RAS to even perform since he is not currently breaking the law.
