Security guard at DMV say NO

I've NEVER had an issue at the DMV, any of them. My buddy however did. The DMV in the N/W on Decatur. He went in today and security told him that OC is NOT allowed. He is non confrontational and a won't speak up to save his life so he went outside and locked it up in his vehicle. I have no doubt that I wouldn't have had an issue as I would have demanded a supervisor and quoted them the law. Anyways, it appears as if the security guard at the N/W Decatur DMV is offering up bad information.

Hard to blame him. Will he at least follow up afterward with a letter, or at least an email? Or should we do it for him? Assuming the latter, can we get some specifics like time of day, and a description of the security guard and what entrance was used?

Does he at least KNOW he was in the right, and that if it had actually been illegal, there would have been no "that's not allowed," but rather just an arrest?

Does anyone know what signage is present at that location?

Took my CCW class this past Saturday. Confirmation email for class attendance stated "no open carry firearms in class". Attended with empty Serpa holster and loaded spare mag holster. Sat and listened to the, I'm certain, Sheriff association mandated nonsense about "Open carry is legal, but.....". You know what comes next, "Could scare people, brings attention of police, criminals might try to steal it......". Kept me mouth firmly shut. Learned more in 30 seconds with an instructor on the range than I did in the class. All in all a positive, although rather boring, day.
Monday I went to the Washoe County Sheriff's office to submit my application for my CCW. Had read a few other OCDO stories about others who have gone in there. Decided it was prudent to go in with empty holsters(gun in lock box in pickup) considering results others have had. Waited my turn(1.5 hrs) then went back to answer questions and get photoed. Lady commented on my OC. Told her why my holsters were empty and disagreed with her when she said, " It's the law". So wish I could have had more time to ask for a supervisor, but I was nearing c.o.b. Finished my business and departed, after reholstering my pistol in the parking lot. No real issues, but I have started to draft a letter to the Sheriff asking why he hasn't made to the unlawful policy yet.

I DO NOT plan to become a Conceal only carrier. Have become very comfortable with having it visible when I go out.

There is no mandated lecture to be given about open carry. Which means they just WANTED to mention it just to tell you why they are scared of it.

You should know that our rules require CCW instructors to be the ones doing the range time as well as the classroom. They can be different people, as long as both are certified CCW instructors by the sheriff's office, in which case, both should have signed your application form.

You have an excellent foundation for an official follow-up letter asking for clarification. Now, they'll have to not only come up with something, but put it in writing.

All sign offs complete. The same instructor that did classroom also supervised shooters at the range. A different instructor gave me pointers to help fix grip issues I was having.
Now I just have to wait. Washoe County seems to be right at the high end of the wait spectrum at 90-120 days for issuance.

You have asked whether the open carry of firearms is prohibited in a public building. To answer your
question, we must first discuss the issue of the legality of open carry of firearms in this State.
Section 11 of Article 1 of the Nevada Constitution provides that “[e]very citizen has the right to keep
and bear arms for security and defense, for lawful hunting and recreational use and for other lawful
purposes.” However, the constitutional right to keep and bear arms is not an absolute right, and the
Nevada Legislature has enacted certain restrictions on the right to keep and bear arms. For example, the
Legislature has enacted NRS 202.350, which generally prohibits the carrying of concealed weapons,
including firearms. The Legislature has also enacted NRS 202.360, which prohibits certain persons from
owning or possessing firearms, including, for example, convicted felons who have not received a pardon
restoring their right to bear arms, fugitives from justice and persons who are mentally ill. The
Legislature has not, however, enacted any statute that prohibits the open carry of firearms by persons
who are otherwise authorized to possess firearms. For that reason, open carry of firearms by a person
who is not prohibited from possessing firearms is legal in Nevada, subject only to any specific
prohibitions against carrying a firearm in certain locations.
With respect to such specific prohibitions that would apply to the open carry of firearms, NRS 202.265
generally prohibits the carrying or possession of firearms while on the property of the Nevada System of
Higher Education, a private or public school or child care facility, or while in a vehicle of a private or
public school or child care facility. Likewise, NRS 218A.905 specifically prohibits a person from
possessing a firearm in the Legislative Building “without legal authority.” Possession of a permit to
carry a concealed firearm is one type of legal authority that allows a person to carry a concealed firearm
in the Legislative Building.
This office is aware that some persons have argued that NRS 202.3673 prohibits the open carry of
firearms in a public building. However, that argument is not legally sound because NRS 202.3673, by its
plain language, regulates only the carrying of a concealed firearm by a person who has a permit to carry
a concealed firearm. NRS 202.3673 simply does not apply to the open carry of firearms in a public
building.
{Because there is no general statutory prohibition against the open carry of firearms in a public building,
it is the opinion of this office that the open carry of firearms is not prohibited in a public building,)
unless
otherwise prohibited by a specific statute such as NRS 202.265 or 218A.905. We would note, however,
that not all portions of a public building are necessarily open to access by the public, and persons who
are openly carrying firearms are not, therefore, authorized to carry firearms in all portions of a public
building.

Thanks 28kfps, that written communication about OC, in regards to the question of the DMV, will be a nice addition to my letter to Sheriff Allen in Washoe County.

Very plain text that even an elected LE official should be able to understand.

As far as carry in a ccw class. I took my renewal along with about 15 other people in my home with Mac as the instructor. Myself, Mac, my wife and maybe one or two more were all open carry. As it should be.

Back at the Pahrump DMV OCing again trying to get my new to me pusher RV tagged. Ended up being there late after the doors were locked. They had one of the workers I believe he was one of the vehicle inspectors standing at the locked door to let people out. As I went out the worker asked me what I was carrying. Ended up talking about guns for the next 10 minutes.

OCed at the Pahrump BofA as I walked in just as I got in line a old guy (For me to be able to say that he was really old) at one of the windows asked one of the female workers if it was ok to have a gun in the bank. She said absolutely and explained the NV gun laws to him. I was very impressed at her knowledge. He then started taking about wanting to carry. I had a chance to step out of line and I gave him a card I made up with the OC web pages on it. As I was waiting in line the lady came over to where I was and I complemented her on explaining the laws. She said she is pro gun and has her CCW and has a good knowledge of the law. She says I like seeing costumers in carrying. We had a good pro talk about carrying right in front of several that were in line. I gave her one of my information cards. Ok now my turn to head to the window which happened to be the same window the old man was at. As I was telling guy teller what I banking stuff I wanted to do he said when we are done here I also would like one of your cards.

Could've been a bad ending if I wasn't OCing

Had a very interesting OC day. Went to the Marshalls on Rainbow and Cheyenne and as I got to my car this man drives up in his truck and starts to compliment me. I, in return, say "thank you" and thought that the conversation was over. Oh...how wrong I was. I then noticed that he didn't drive off but continued to ask me questions..."Do you have a boyfriend?"..."Do you want a boyfriend?"... "Why is a beautiful girl like you not have a man?". So I just told him, AGAIN, that I'm not interested. Then it turned into "Well, I want to be your boyfriend." Again...I stated I wasn't interested. The he says " Well, how about a man that can just give you the best sex you ever had". At this point I threw my Marshalls bag and my purse into my car through the sunroof and I start walking towards the front of my car putting distance between us. The parking lot was not full so I had plenty of space to run...just in case. Then this yahoo begins to open his door and says "why don't we just talk for a little while?". At this point I tell him that he should just stay in his truck and leave (as I placed my hand on my gun). I guess THAT finally told him that I wasn't interested and he closes the door and drives off!!!!
