No matter which way this Judge's ruling goes, the case is very likely to end up before a divided Supreme Court a year or so after the decision is handed down. My bet is that this Judge is playing the calendar assuming that the longer the case gets dragged out, the better the chance that a left-leaning Supreme Court will finally hear the case.

To be a bit more blunt, I believe the Judge is waiting for a conservative justice to die or retire.

This Judge has DC (and the United States) in a trick bag, for crying out loud!! This doesn't make any sense to me at all. It seems like there should be some kind of time limit as to when this Judge must rule on a case. What happens if this Judge dies......then what?!? Do they get another Judge and he/she has to look at the testimony, or do they actually have to hear the case again?!? We have been waiting on a desicion for quite some time now!!! If I had a job and was not doing it, I would be fired......especially if I was not doing it for some political belief!!! Why has someone not fired this Judge for not doing his f$#^&*g job?!? So frustrating.....I tell you! I know that it's not helping this situation, but it feels good to get my feelings about this mess out there!! My rant is now over!!!

Palmer v. DC reassigned to another judge

The case was reassigned today to another judge, Judge Frederick J. Scullin, Jr., a senior status judge from the Northern District of NY, sitting by designation by Chief Justice Roberts. Scullin's background is that he was appointed by Bush I to the bench, he was appointed as a US Attorney by Reagan. He served in Vietnam and retired from the Army as a Colonel. He was an Airborne Ranger. I think it is safe to say he is familiar with firearms, but that does not necessarily mean he will be sympathetic to the case. Hopefully he will not require reargument of the pending motions. He has set a status conference for this Friday. We may finally have action in this case shortly. Here is the order assigning him the case.

New Filing in Case

Alan Gura made the attached filing today in the case to bring the court's attention to the decision of the 7th Circuit in Ezell v. City of Chicago.

Alan Gura mentions this case at the end of his petition to SCOTUS for the National Park ban case. He mentioned the disgusting year and a half delay.

If they grant cert to the park ban case, then this case will be decided soon after SCOTUS says: "No really, the right to bear arms does exist outside the home."

I think the CHief Justice reassigned this case to get it done quickly. If GUra doesn't get cert in his gun ban case, then I think this will be the "Bear Arms" case.

Saturday will mark 2 years since the filing without a decision. I know we have a new judge now, but he is a senior judge. they often only work 3 or 4 months a year. Do you think we will get a ruling this year?

We'll get something this year-either an actual ruling or a (don't know the legal term) where the judge will hold the decision because of SCOTUS taking one or more of the carry cases currently pending.

This may seem silly, but is there a way to bring a suit against a judge for failing to perform his job duties...?
