He's still slated to hear a few cases this month, although just from a glance it looks like his case load is much less than the other judges.

I also see the Creed case was just filed in summer of 2010. So for whatever reason Palmer is being avoided, as he is apparently able to rule on cases filed a YEAR after Palmer.

Update: I searched the opinions again, and found he ruled on this case https://ecf.dcd.uscourts.gov/cgi-bin/show_public_doc?2009cv1808-9 just this week. It looks to have been filed around the same time as Palmer, and its not a habeus case. So let's hope Palmer is next, whenever that may be.

I think Kennedy is waiting for the DC Circuit to act on Heller II which should articulate a standard of review for the firearms related cases in the District of Columbia. Heller II is due to come out any day now, perhaps as early as tomorrow. I don't agree with waiting, but that is the only thing I can think of that explains why this is taking so long. In the meantime, as a DC resident, the delay permits a continuing denial of my second amendment right to effectively protect myself outside my home.

It is a perfectly reasonable stance for Judge Kennedy. It is your fundamental right compared to his judicial reputation. Which do you think is more important to him?

Could be. If Heller II is ruled on statutory grounds(DC HRA), then Kennedy's decision should be pretty short and easy.

Seems like a very good date - Thursday July 14 - for a protest at the DC Fedral District Court.

I'm thinking maybe they should put that Puerto Rico case in as supplemental authority, maybe just as a prod to Justice Kennedy just so he knows that yes, we're still waiting on YOU!!!

July, year is half over and still no decision. My money is riding on a 2012 decision.

I wrote the clerk of the court an e-mail and asked that my query about this gross delay of a civil rights case be forwarded to the chief justice.

No answer from the clerk or the chief justice.
