$1200 in fines
No search waiver.

CalTrans and fines suspended until June '10 or completion of appeal.

Great news brother. It would be hard for them to justify putting you in jail on a first offence non-violent crime. Onward to the appeal, and victory! :)

Well that's a relief. I'm glad you're going to remain a free man through all of this.

I can't tell you how many court opinions I've read lately where the district court screwed up a ruling and was quickly overruled by the appellate court. I'm sure your case will be another notch on the district court idiocy pole.

3 years probation for a misdemeanor and $1200 in fines?!? WTF?!! What the hell is going on in that state?! criminals who rape and kill get less punishment...

I have a feeling the high fines and long requorements were applied because he fought it instead of taking plea-bqrgains offered before pre-trial. The system working fair and just my ass.

Theseus, sorry for your sentence. At least you are not posting from the LA County jail. You have many people that support you and your situation and feel it is unfair.

Can you share any comments the judge made during sentencing, and are you barred from weapons possession? The judge at least did not maximize the possible sentencing. Frankly this is not much different a sentence and fine than for a DUI. Keep us informed on your next (appeal) steps.

OC'ing was never going to be easy, and you have suffered far more than necessary. Fighting for a cause that only a minority are passionate about always has a price. Oc'ing is full of land mines in California, and frankly you stepped on one. I hope you still feel in your heart the fight was worthwhile.

More commonly known as a "Fourth Waiver".

A common condition of probation and parole is a waiver of your 4th Amendment right against unreasonable search and seizure, in other words, any law enforcement officer (parole/probation/police) can search you, possessions under your immediate control, your vehicle, and your home anywhere, anytime.

Since the 4A already might as well not apply to law-abiding gun owners, I guess the judge figured waiving it would just be redundant.

I was never offered a deal as they believed, rightly, that if it had weapons conditions I would not accept.

There is strong evidence that they knew the only way to make me "go away" or stop "open carrying" was to take my guns. They apparently didn't decide to charge me in this case until there was another incident by me in Alhambra where they didn't get to detain me. They brought the charges because they wanted me to stop and didn't have any other way to get me to.

They may have won for the moment, but I know you'll prevail in the appeals process. At which time we should be post 2A incorporation.Wouldn't it be great to have a great big OC protest at the very spot they chose to persecute you?! Alhambra we are coming! ...to be continued
