Wrong, no the government does not rule by majority rule and have authority over an individual! The rule of law is what governs an individual, natural rights govern an individual. Majority law is overturned by the courts when it exceeds natural and fundamental rights.
well head on over to Zimbabwe and tell me how those "natural rights" are working out. Head over to Somalia, and tell me how many "fundemental rights" they have this week, how about communist china? or even France? Doesn't sound like Divine planning to me...
The very fact that the majority of humans living today do not have these rights should be a clue to the "fundemental rights" crowd that there is no such thing. Rights are not inalieable, no one was just "given" rights, rights are something people TOOK or that someone else TOOK for you and you must MAINTAIN god isn't coming to bail us out if we lose our rights. tell me how often "fundemental rights" appears in the constitution? ZIP ZERO, NADA.
Either you fight for your rights, have someone else fight for them for you, or they will be taken from you.
one last homework assignment, google "Japanese Americans 1942" and then tell me all about your frickin' natural rights. obviously "the greatest generation" had no problem rounding up american citizens and holding them without trial, without charges, no right to a lawyer, and had their property taken by force with no compensation. you ever visit pike place market? in 1941 70% of the stores at Pike Place were owned by japanese americans? are they now? no, why? oh becuase their "natural rights" were not as useful as a roll of TP when worst came to worst.
so name me ONE group of people who had "rights" by the basis of existing without having to fight for them? name one... they don't exist, in my sutdies of history I haven't found one group of people who had rights by nature of existing, they always came together, said "enough is enough" and TOOK THEIR RIGHTS (often violently) from their oppressors. God, Nature, the Easter bunny, or John Locke didn't amount to a hill of beans when it came to taking them
The government in the end rules for the majority, or in some cases, a minority big, bad, and violent enough to keep control over the majority. governments only give you rights if they feel it's the easier path to take. to claim that the courts will uphold your rights all the time is ludicrous, look up Jose Padilla if you don't believe me. YOU are responsible for your rights, you and the public at large, and if the majority of the public won't stand up for your rights, you WILL lose them. there is no way reading back through history you can conclude otherwise. Even in the bible Essau sold his rights for a bowl of porridge. having rights is not a given, it's not "god given" it's not "easy" having rights brings with them serious responsibility, including keeping them. to claim your rights are fundemental is an insult to thousands, tens of thousands, hundreds of people who died so you can have them. there is nothing fundemental about it.
