An Idaho police officer fatally shot a man in his own backyard Monday while searching a neighborhood for a suspect believed to be armed, officials said.

Officers and deputies surrounded the residence and backyard in order to prevent the suspect from fleeing," the statement said. "Due to the information that the suspect may be armed, and a prior history of violence when interacting with police officers, law enforcement personnel entered the location with their service weapons drawn."

We do not currently have the answers as to what exactly occurred during these moments," Idaho Falls police Chief Bryce Johnson said. "We do know that during this interaction, an Idaho Falls police officer discharged his service weapon firing one shot which struck the man."

Body camera footage of the incident has not been released.

“There are no words to express how heavy our hearts are today,” Johnson said. “This situation is devastatingly tragic for the family, for the officer, and those that love and care about them. We all feel the weight of what has occurred today. Our sincere sympathies are with the family and friends of those involved, most especially the family of the deceased.”
The chief went on to say: Even though we have heavy hearts it will be a cold day in hell before they receive one damn dime from the city.

Police have not identified anyone involved in the incident, but told NBC News the suspect and the victim are white and the officer who fired his weapon is Latino.
Eliminating racists?

This is the police's side of the story. The other side is six feet under.

Exigent circumstances...no stinking warrant required...presently armed AND dangerous...black shirt...reasonable belief...cops will say so...we investigated ourselves...we found no wrong doing or policy violations...the shooter walks...

I agree to the acquittal part; I acquit myself all the time as I am sure you acquit yourself all the time.

Exigent circumstances - "circumstances that would cause a reasonable person to believe that entry (or other relevant prompt action) was necessary to prevent physical harm to the officers or other persons, the destruction of relevant evidence, the escape of the suspect, or some other consequence improperly frustrating legitimate law enforcement efforts."

The right to enter, maybe, but not the right to shoot. There has to be more.

The suspect had a felony warrant...the suspect is alleged to have been in possession of a gun, as reported by a citizen, that night, who thought he saw a gun, is the exigent circumstance. There is no report that a gun was recovered from the suspect...

Curtilage only works after the fact...maybe...cops can go where they want , when they want...courts have reaffirmed this time and again...after the fact...not that this will provide comfort to the dead or his survivors...

The homeowner will be held responsible for his own demise...

The Idaho Falls Police Department defines Officer Involved Shootings as "any incident where, in the course of their duties, an Officer discharges their service weapon resulting in the death or injury of another person.
Interesting...discharging a service weapon lacking the two criteria do not warrant a investigation as a "Officer Involved Shooting"....hmm...oh-kay...

The backyard is small...~6 ft cinder block wall...3 ft chain link gate and a ~6 ft wood slat gate. A photo of the family in front of their home holding a sold sign. Note the door, brick colors and black mail box.
