Preemption hasn't been around that long. It is even more recent that the OHSC upheld preemption. Some signs predate preemption and some signs are the result of mindsets that preexisted preemption being still around because of ignorance of preemption. Most of this stuff are just mistakes. You can tell by how quickly they are corrected once pointed out.

There are some localities that are trying to exercise power that they know they do not legally have, but they are the exception, not the rule.

I agree about some being mistakes but as in this case the signs refer to a different law that wouldn't have even applied to the fair grounds even before preemption.

That could very well be what happened and if so we agree it was just incompetence and not done with deception or malice in mind.

If you are coming to Mt. Gilead via I-71 to 61, then I would suggest meeting up at a restaurant at that freeway exit.

I don't remember what's there, but McDonald's is a likely candidate. If no McDonald's, then Wendy's.

We can head to the fair from there.


I won't be checking this site or my email after 1pm.

FYI- There is a Certified gas station right outside fair gate "A", but it is a CPZ.

The only restaurant my mapping programs show at the exit for 61 off of 71 is an Arby's.

What time do we want to meet at the exit?

I am about to set out, make some other stops, and head that way. I will look for a McDonald's at the exit from 71 onto 61 (exit 140). If no McDonald's, Wendy's. If no Wendy's, Arby's.

I will have my iPad, so I can read this thread.

The fairgrounds is 15 minutes from the freeway.

If we are all at the restaurant (looks like Arby's) by 2:45pm, we can leave for the fair.

I do not know what the parking situation is like (location and cost).

I am headed out now and won't be in cell range.

Good times at the Morrow County Fair. No incidents of significance to report. The LEOs at the Fair knew we'd be there and knew the law. A few of them greeted us an moved on. Most just ignored us. MWSY overheard a snippet of a convo that indicated that, as long as we didn't do anything out of the ordinary, they knew that they had to leave us alone.

We bumped into Morrow County Sheriff. He had a healthy respect for the law and for the rights of the People. Kudos to him. If I lived in Morrow County, I'd be an active supporter of him in his reelection efforts.

We also got a lesson in how not to conceal anything.

I am sure MWSY, Chuck, and the Brians will share more.

I will post a few pictures from my iPad when I am on it next.

Oh, we also ran into someone whose initials were surely DM. You should have heard some of his boastful bluster! Of course, he had not pictures, videos, or audio.

This seems to go along with something a couple of Delaware County residents have told me in the recent past; they both drove to Morrow County to get their concealed carry licenses, because the sheriff in Morrow is friendlier and their office does a better, quicker job of processing them.

I got up there a little early, like to do a bit of recon when visiting places I've never been to. Even from the highway I could see a distinct lack of 'No Guns' signs along the fenceline and gates. Driving in and looking around, more of the same. That told me that someone in authority who actually knows the law likely had a real informative sit down with those who previously didn't. Or had claimed not to anyhow.

Sheriff Brenneman said the Fair Board determined, from their reading of the law, that there were only 3 post-able buildings on the premises. First Lorain, now here... I find it interesting that some fairs are going from illegally posted to FULL access to shelters and such WITHOUT the posting of "shelter" buildings like barns...

Open carry in the fair buildings are legally permissible.

On May 1, 2012 the attorney for Vandalia, Ohio (Gerald McDonald) issued a letter to police chief Douglas Knight discussing issues relating to the open carrying and the concealed carrying of handguns. As to open carry attorney McDonald stated in part:
OPEN CARRY
For the most part the above law is specific to concealed carry, In other words, while a person may be prohibited from carrying a concealed weapon in a public building under 2923.126(B)(9), he would not necessarily be prohibited from having an open weapon in a public building. However, some sections of Chapter 2923 apply to open carry as well as concealed carry weapons, For example, R.C. 2923.126(C) allows private employers and landowner to prohibit persons "from carrying firearms or concealed firearms" on private land by posting a sign. (Subject to certain exceptions.) likewise, 2923.123 makes it illegal to have a firearm in a courthouse. or in another building or structure in which a courtroom is located. (Based on this, it appears that one cannot carry a firearm, either concealed or open, into the Vandalia Justice Center)
This is why the ORC only points to five places that carrying open or concealed is prohibited. Those are a jail, courthouse or used as a courthouse, school, state run mental hospital and bar (unless you have a CCW).

Nothing really left for me to post.

After doing some public records requests, I find that, originally, the Sheriff DID think that the signs were okay and told Mr. Rogers the same.

In response to the Sheriffs comment, Mr. Rogers replied:
I hope this is correct, the Fair is no place for that many guns. I googled this guy and he has some very way out views. I am all for the 2nd amendment and I am an NRA member but I purchase all of my guns legally and go through all of the checks.

If it was BriKuz that he googled, I wonder what was "way out" in his opinion.

It was Rogers' comment, not the sheriff's.

The sheriff seem to respect our rights. Let's not accidentally impugn his character.
