I hope the OP sues the LEO and LEA to the maximum extent possible. A promise of an apology or new "training" are empty words.

Money is the only thing bureaucracies understand.

I think we need to add one more party to these 1983 suits... had not thought about it before, but the NYC "Police benevolent association" (union) has advised their members not to do anything that will get them (the PBA) sued... Hum, Good idea me thinks, as the union has more influence with the troops than the administration...ya tink?

I don't know California Law -- I brought it up as the Cop did. Someone in the video (not going to assume it was the Person running the camera) agreed with him. From the subsequent posts, I see that this is indeed the case:

"However, several decisions have held that that a citizen does not violate the statute if the
citizen tapes the officer’s spoken words or radio communications where the contact occurs
in a public place"


I doubt this would apply (as this was not in a public place),especially if the Cop asks him to stop.


The gentleman recording knew he was in the wrong, he even tried to fake turning the camera off. Why would he do that if he was in the right?

In the end, he baited the cop into arresting him so he could have something on tape.

All the legitimate cases of abuse and Cops overstepping the mark are overshadowed by ones like these that the media blows up to sell.

All you are doing is hurting your cause as people will eventually stop responding to these 'cry wolf' claims.

Next time try treating the cop with some respect and dignity (you know, like a person) and see the response you get then.

WAIT WAIT WAIT! Why is a South African citizen that doesn't know local law trying to tell us American citizens who know state and federal law that we are in the wrong? I'm not even in the mood to debate with someone who doesn't even live in the country. I'm sure it's standard for SA citizens to submit and live under a police state, here we still have some dignity left. Offended by that statement? Tough!

Found this via reddit (http://photographyisnotacrime.com/2...deo-recording-swat-team-from-public-sidewalk/) and just wanted to mention, that if the admin of this fourm is willing to check the logs, it could be interesting to know if the IP that created that post is from South Africa, or if it's from a more northern location. Wouldn't it be funny if the IP is assigned to a government office in the state of Washington...

Maybe he's an African-African and wants to be an African-American? Or maybe he just wants the rest of the world to be like that bright light of liberty that African countries are... /sarcasm

It was made in the middle of the night... probably not.

He made accusation about the video that are not in the video; either he was there, or someone who was there told him about it. Pretty obvious, there's no need for the theatrics anymore, we can discuss this like gentlemen.

My cousin told me today she saw me on Reddit :)

I think it would be a good idea for the LEO to keep his job, how else is he going to pay for the civil suit he should be losing?

Since there is no qualified immunity associated with a case like this I'm not sure why the city would settle. The suit should be going directly at the officer(s) involved in the rights violation. The taxpayers shouldn't be penalized for the actions of a couple dumb cops.

Lets see he was on duty, in uniform, on an approved raid....yep he will get it. Why do you think he won't? I haven't seen many get it, this is why the city and PD usally pays for the LEO stupidity.

Can you name me one case of a LEO having to pay out of his pocket for doing something stupid while on duty?
