Are you going to get that situation fixed and have them expunge the records from their system?

I'm told there's no way to do that.
I do, however, have the form to get my fingerprints out of the State database, which will be sent in as soon as I remember where I put it... (need work on my filing "system").

That's interesting. I would think there must be some way; unless it's on the police report and public record. It's identifying information after all; considering you are the original purchaser.

... I now own a 'crime gun'.

Of "crime guns " never having been used in a crime, a vast percentage may or may not have been acquired through a private transaction that did not include a background check. That's why we need to close the gun show loophole. If the life of one child can be saved it is worth the gun nuts giving up their Constitutional rights.

Hey - guess what? Since my arrest, and the police (illegally) running the serial # on my Glock, I now own a 'crime gun'.

Not because it was used in a crime, but because the police ran the serial #. (Actually, it was used in a crime, but the police committed the crime against me.)

And that one was bought through an FFL. (I'd been trying to find one through friends of friends, but wasn't getting anywhere.)
Interesting. Then my XD is in the system as well when I was pulled over in Chicago. :cuss:

Not necessarily. It depends on the State. By way of example, in Utah, the Form 4473 is not submitted to any governmental entity. It is maintained by the store. If ATF wants to track a firearm, the query the manufacturer, who discloses what distributor he sold that serial number to. Then ATF queries the Distributor to see what FFL dealer that serial number was sold to. The dealer consults his paperwork and tells ATF what consumer that serial number was sold to.

If there is ever a federal confiscation scheme, there will be a lot of "accidental fires, floods, and burglaries" at the Dealers nationwide. While I do not know what WI law is, I do know that some East Coast States require a copy of the Federal 4473 be sent to the State Police (or other entity).

So when a Dealer or Store goes out of business what do you think happens to the 4473's.
I believe the ATF gets them.
To me thats the chicken being sent to the fox.

That's interesting in light of the Milwaukee paper's crusade against a gunstore. When you have chance could you find a cite link and pm me or post it here if you wish.

Whether or not there has been a law, or S.C. decision changing it, I don't know. I'm trying to read and understand S.C. cases regarding the 2nd Amendment. Thus, I'm working my way to the present, but I'm not there yet, so there may be a new case that contradicts the one I posted above.

IMHO, selling a used firearm is like selling a used car. When the deal is done,it's done. And if the new owner decides to do somthing stupid with his new purchase wether it be a car or a gun, that's not my problem, nor my concern.

On a related note, Whenever I sell a firearm, I check ID, write up a bill of sale, and do a quik CCAP search just to make sure sed person is not a felon. Not required by law, but it does help me sleep better at night.
