Hampton Roads - OC reports

I saw a Hampton LEO at Wynne Ford so I decided to pick his knowledge of the knife laws and as suspected his understanding was underwhelming. He was stuck on some vague rule that if the knife was longer than four-finger-width that an officer may have a problem with someone CC-ing it. I asked what four-fingers-width was and he said it was a general rule. So I wonder if general rules outweigh actual Virginia Law.

The confusion comes in where specifically it is illegal to "conceal" a bowie knife, etc http://leg1.state.va.us/cgi-bin/legp504.exe?000+cod+18.2-308 but the law never says anything about other knives so technically you should be able to conceal them. Since VA doesn't have a CWP though it is a bit confusing as to what is considered a weapon. Then there is the local ordinaces since there is no knife-preemption in VA.

I know that LEO are not good places to go to for legal information but wanted to see what he considered lawful in case I ever had a LEO run in while carrying some of my larger knives. I have to say that he was a nice person to talk to and all while I was OC-ing with no issues.

stayed late at the bike shop today, then went to Subway at 8:00pm or so to grab some breakfast...yeah...it was a long day!

While gulping down a hearty sub and chatting with one of the managers there, who i converse with frequently, two of York County's finest walked in. They ordered and sat down to enjoy their meals. I was OC'in my XDm40, as always. They were talking about a case that had gone down earlier in the day (i wasn't eaves-dropping....just over-hearing :p ) when I got up to refill my cup-o-sweet tea. There was a slight pause as i passed strong-side, but then they resumed talking as I topped off my cup right next to their booth.

Sheriff Danny Diggs runs a smooth operation of fairly well-informed officers. Two thumbs up!

While it may seem a bit vague, there has been at least one case I read about (can't find it now) where a judge dismissed/acquitted based on this criteria, specifically because the type of knife involved was a steak knife, and since it was never intended to be used otherwise, it didn't qualify as a "weapon of like kind".:eek:

Pour two fingers of whiskey, throw three fingered fast balls, but don't CC four fingered knives? Gotta love that folklore.

Thanks for pointing that subsection. The question is then what is a "like kind"? It is vague enough just to be used against you. I would prefer if they just said something specific like "a blade 5" or longer", not that I want that. Of course they may choose to follow the school code of 3" or longer, to make the children safe!

I don't know about others on the forum here but I feel comfortable OC-ing a handgun but shy about OC-ing a 7" knife. I would rather throw it in my coat.

Then you would be carrying a concealed weapon not covered by your CHP.

Be aware that there a many different local ordinances regarding knives - a mish mash of different rules separated by invisible lines. Which is why VCDL would like to see the state totally occupy the field of defensive tools and bring conformity to the issue.

i was wondering about conceal carrying a boot knife the other day. I have yet to do it. from reading this, ill hold off.

In the mean time, off to OC to the Bottom dollar and get the usual "you can go ahead of me, have a really nice day, thank you" polite service. I swear, wearing a gun on your hip scares the **** out of some people....

OC'd over the past few days at the following places: Southside Eye Care and Advance Auto Parts in Western Branch area of Portsmouth, YoYo Sushi, Dick's Sporting Goods, and Kohl's in Harbor View area of Suffolk, Subway in Carrollton. No issues and there was even an employee at Southside that was an avid shooter/competitor who enjoyed talking firearms with me.

OC-ed to Japan Samurai to pick up some takeout for my daughter, then went to Chili's with my youngest. No issues.

Also thought I OC-ed to Farm Fresh until I realized the wind blew my coat out of the VA tuck. Finally OC-ed at Shell.

My first open carry experience was yesterday. :banana:

I got a few stares, a couple people crossed to the other side of the isle, and a nod accompanied with an "officer".

Went to, the NEX, Farm Fresh, and Autozone

question though, you "open carried" at the NEX???? As in the Navy Exchange?
Can you tell us which one? and how it was that you weren't hauled away in chains and now residing in a Federal Brig?

Enigma, as a sailor, I know what you can and cannot do on federal military land. Unless you are acting in your official duty, why did you OC at the NEX???????????

If I can remember, 11/24 9pm in line at walmart, leave around 12:30. About 6 cops and about four saw me. 11/25 walmart x3 target, bestbuy, office max. Today walmart 2x and target.

Mad lines at walmart on 11/24 lol. I was able to hand out a oc card to a guy who has another state permit but he saws VA doesnt honor it. I told him OC was legal.

I OC'd in the Hope Depot and Lowes on Battlefield today as well as the Home Depot on Hillcrest, The Target in Greenbrier and Sears in Greenbrier mall with no issues. I also went into the Lafayette branch of the Norfolk Public Library today and was told that I couldn't carry a gun in there. The lady behind the counter said that it was posted on the door no weapons. Then I showed her on the sign that the policy actually says no carrying of unlawful weapons and told her that me and my gun were completely law abiding she said she would have to ask her supervisor who in turn said that i was not violating the Library's Code of Conduct and was fine with the gun on my side.

Time for someone to get a card from Ed! preemption applies its a PUBLIC library.


Does anyone know what happens if police come/ask you to leave, it's under preemption so how could they charge you?

Hopefully you got the person's name, but probably not completely necessary.

Would be a good thing to send correspondence to the Library Director, quoting the state preemption law, and asking that this be corrected.
