On March 29, 2019, the Honorable Roger T. Benitez, United States District Judge, blocked all enforcement of California Penal Code section 32310. He also required notice to all law enforcement entities and a filing of proof of notice from the defendant, Attorney General Xavier Becerra.

With respect, the 86 page order contains an abundance of precedent at the Federal and Supreme Court levels We the People can use in our fight against the gun control/ban efforts of Democrats in order to protect and preserve our right to keep and bear arms BEFORE they're infringed.

I commend them to your care and subsequent use to the maximum extent possible.

Already posted. This need to be merged with the original posting. John, a little moderating of the forum would be appreciated, like locking and merging threads that addresses the same subject matter.

The original posting sucked. I provided far better links and even a graphic.

So, John the Admin, if you would, please just let 'er ride. Thanks!

Soooo...Californians can own magazines that hold more than 10 rounds...in their home...

Are you certain this didn't also apply to carry outside the home? And if you would, please, cite why you think that's so.

As Color of Law stated elswhere:

It's a good ruling in regards to capacity. But the court think your 2A rights only apply in your home. That is not what Heller said.

In 2008 the United States Supreme Court in District of Columbia v. Heller, 554 U.S. 570, 592, 171 L.Ed 2d 637, 128 S.Ct. 2783 (2008) declared “we find that they guarantee the individual right to possess and carry weapons in case of confrontation. This meaning is strongly confirmed by the historical background of the Second Amendment.” The Court then cited Cruikshank as part of its historical analysis. Thus, Heller held that the right to bear arms for a lawful purpose was secured by the U.S. Constitution.

More importantly, Heller did not limit the right to bear arms. It specifically stated, “Second Amendment implicitly recognizes the pre-existence of the right and declares only that it ‘shall not be infringed.” The Court reiterated, “Our opinion is, that any law, State or Federal, is repugnant to the Constitution, and void, which contravenes this right, originally belonging to our forefathers.”

Heller did not rule just in the home.

As Color of Law stated elswhere[sic]:
The realities on the ground in California regarding the carry of a firearm. Being absurd to illustrate absurdity. My apologies for not being more precise in my post. When you find a state that does not observe Heller let us know.

So since9, you have anointed yourself as OCDO’s quality control oracle of forum over initial thread posts?

So if you decide you don’t like the OP’s initial posted material, instead of posting your own viable material in the next slot, your egotistical mind starts a new thread?

When called out on it, you then play the martyr card for the membership’s court of public opinion and to the owner....

Got it!

Tis a wonder your ego would fit in the helmet!

You could have added your “better links and even a graphic” to the original thread.
