Even if you're 100% factual, objective, balanced, fair etc, the opposing side will see it as an attack.
Exactly... I don't make the claim that FoxNews is perfect in their implementation of "Fair and Balanced", but even if they were, the rest of the liberal media and establishment sees them only "far to their right" rather than "middle".

Confirmed by the admission of many in previous years who said they didn't know a single person who voted for George Bush... The world just doesn't exist out past "middle".

I have another thought on this. There are questions about what was said to whom and when and why. If he were OCing instead of CCing (yes I am ignoring that fact that maybe he could not OC because I am not in PA) he might have had a recorder of some sort with him recording away. I think this is an advantage that one who OCs has over those who CC. Those who CC don't learn to protect themselves (general opinion) in the same way that an OCer might. I have my VOX going when I OC, so while I doubt anything will ever happen by virtue of OC, I am at least more prepared to be able to have a better account from a more reliable source than my CCing brethren.

Any news from his trial today?? the link doesnt work anymore for the court documents. I was wondering if it is over now?

I found this link for an update on the trial, on which, ung is supposed to take the stand on Monday. Check it out at

They might have been updating it. The commonwealth rested and motion for acquittal was denied. The next trial date is Monday the 14th.

Temple student not guilty in Old City shooting

Gerald Ung, the Temple University Law School student who shot a man six times on an Old City sidewalk last year, was found not guilty by a Philadelphia jury this afternoon.

The verdict means the jury of six men and six women believed Ung when he testified yesterday that he acted in self-defense. The jury began deliberations at 11:32 this morning.

Ung, 29, was charged with attempted murder, aggravated assault and possession of an instrument of crime for shooting Edward DiDonato Jr. shortly after 2:30 a.m. Jan. 17, 2010.

According to an earlier report, the jury went out just before noon. Sounds like they barely had time to review all the evidence. This tells me it was not even close. The Philly DA's office should be reprimanded for even thinking about bringing this case to trial.

That's refreshing that even up North, there is still some justice. There should be a place in Heaven for Ung because he's already done his time in Hell.

The cross-examination by Assistant District Attorney Jan McDermott was appalling. As revealed here, she actually suggested the 'Lone Ranger' option of shooting at the arms or legs, or perhaps firing a 'warning shot' or even a duty to retreat.

Could a persecution like that happen in Virginia?

On cross examination from Assistant District Attorney Jan McDermott, Ung said he always took his loaded gun with him when he went out drinking. He said he never saw a weapon on DiDonato or his friends.

She said that it was his duty to retreat or possibly call 9-1-1 if he was threatened, but that he didn’t. She questioned him about having other options and talked about him having his hand in his pocket where the loaded semi-automatic was placed, from the start.

”I know I pulled out my gun at Thomas and he froze in his tracks,” Ung testified. “Then I pointed it at Eddie. It was like being in a movie I was in a daze.”

McDermott then stated, “You never fired a warning shot or shot at his arms or legs just at his chest and abdomen?

Ung replied: “He just kept coming”

It was a travesty that a PR firm could get the DA to file because of a Daddy Warbucks owning the system. It is a good resolution after seeing the video it is hard to believe that it was allowed to go to trial.

After reading the notes I think the defense should have asked the officers about some of the points that the prosecutor seems to have been trying to make (hearsay per his notes).

Ask officers about warning shots and if they use them.
Ask officers about shooting to disable versus shooting center of mass and training per se.

Although, it has so far turned out well for Ung and I am glad the criminal part is over it sounds like the aggressor's father has deep pockets and may attempt a civil retribution lawsuit.
