The absence of a law statute or penal code never stopped many officers from some of their actions. I can personally attest to situations where there was no law, written department policy against, and radio conversation stating they had no reason\authority and they still committed their illegal actions. Bottom line is they will continue to do as they please until they are held accountable for their actions.

You're preaching to the choir here, dude! I recently finished an entire series of trials, expungements and lawsuits for wrongful actions, 1997 to 2012. Not only did I have to sue for wrongful actions, they then conspired to retaliate and placed more bogus charges..... resulting in even more lawsuits! I prevailed in everything I filed. But the point is there has to be more to confiscate a motor vehicle than simply a 20+ speeding offense.

I drive for a living and can speak from personal eye wittness experience. Speeding is nothing to take lightly. Speeding in any motor vehicle is deadly to driver and everyone around him/her. More offten than not the driver is the last one to get hurt. Do I usually agree with law enforcement and the way the abuse their privilages.....NO..... since this is a open carry forum ill make an analogie. (which will be torn apart im sure) Both cars and guns can be dangerous weapons. If you saw a guy waving his gun around wouldent you want someone to take it from him before he hurts someone? A guy doing 20+ or the crazy gun guy are both displaying poor judgment and breaking a serious law. Which brings me to a little bit of a rant about A-holes who are making the roads a dangerous place to be. No not all accidents are 100% preventable they are "accidents" for a reason. But really the texting, eating, reading, cloths changing, makeup applying, sleeping, web serfing, and gameplaying, YES GAMEPLAYING is going to impare even the worlds best drivers. I have driven from coast to coast in our country many many many times and have seen everysingle thing listed with my own eyes. My family and I have to share the road with you please drive safe. Rant complete

P.s. dont claim to be an awesome driver and I do drive distracted like anyone els with my main distraction being the radio and the hot girl changing cloths in the car next to me.... and yes the view is amazing from the seat of a truck.

It would generally be best, I think, to "secure" the gun in a "closed container in the vehicle" before the cop gets out of his car, to avoid the whole scene.

When I suggested putting the weapon in the glove box before the cop got out of his vehicle in another thread, certain senior members of this forum responded that it was horrible advice and dangerous. I have personally done this with no issues, and will likely try to do so in the future before even stopping. Avoids a lot of issues. I keep my papers in center console so I don't need to go into glove box.

Speeding alone is not dangerous. Most speed limits are set too low to be safe. If speeding were dangerous, we'd hear about more problems how the Autobahn is "so dangerous."

The speed limit is only to slow for someone who did not plan accordingly and is now in some kind of hurry. Ask a German what its like to drive on the autobahn. I bet he will say its completely different from anything America does. And here is a short and incomplete list of things that are illegal on the AUTOBAHN off the top of my head: Using the left lane for anything other than passing is strictly prohibited and extremely enforced, Tailgating, and passing someone on their right.

if I were to tell of what I saw at about 3am while driving on US301 in Delaware about 7 or 8 years ago, most people wouldn't believe me. Heck I wouldn't believe me if I hadn't seen it for myself. The image is firmly imprinted in my mind and brings a smile to my face every time I recall it and, yes, the viewing angle from the driver's seat of a truck is a good one .....

Do you happen to have the cite which says all traffic stops qualify as arrests? I do understand that if the OP was going over a certain amount, it becomes "reckless driving" and it is a crime. I am asking about regular traffic stops for say, 5 over.

I mean, if every traffic stop counts as an arrest, wouldn't they have to read you your rights before asking, "Do you know how fast you were going?"

One thing I learned when I was stopped for doing 20+ on the highway in VA is with it being reckless driving charge the officer not only can write the ticket for that which give a very high amount of points, but can also, arrest you, have a mandatory court hearing, and possibly have your license suspended after all is said and done. Again this is not only what I have been told but have confirmed in the past as well. Just a little bit of side info.

I should also say thankfully there was a more pressing call so the officer left giving me a warning

Anything 10 over or 80 mph is considered reckless driving. One reason why I wouldn't live in VA.

LEO's are only exempt from the speed laws if they have their lights or siren on. It's normal to see them cruising well over the 20 or 80 mph cap.

It would be interesting to see that enforced.:lol:

I stand corrected...several times! heh

I keep getting the 10 over because the last time I was in VA, the freeway was 70...I remembered the 80mph quite clearly from another forum I'm on.

I was walking to Food Lion of Lynnhaven Parkway and I was stopped by the police. A officer said he was going to take my gun for safety and ask for ID ( I can see why I'm only 18 and look pretty young). I had to kinda help him unload it (lol) them carrying Glock 17 and me a M1911 (a lot more external safeties). He took me home and we had a small conversation on how the federal age restriction on purchasing ammo and pistols was pretty dumb. I would of been fine if they officers weren't there but there was a break-in so...ya.

Why did you show it?
Why did he take you home?
Did you have a break in while the cop was there?
