he reached through the window and removed it. i was never removed from the car. i wouldnt have told him except i thought he would see it and figured it was better than surprising him.

I agree. I don't care what people say, announcing your firearm (especially if it's in plain view) beats having a gun screwed in your ear.

Tinting only dims if the brightness of the bulbs is not increased. Most automotive tail lights FAR exceed the legal specifications of all states to account for them being dirty.

"Dirty tail lights" is easily used as a fishing expedition, and almost as good as 'he must have a short somewhere, his tail lights flickered off for a moment."

Anyone can walk up to you and ASK you for your gun, and you can tell them no.... I don't see a problem with that...

A cop can't demand your gun or take your gun unless they suspect you of crime. I also don't have a problem with that... How is an officer supposed to do his job if he can't seize a weapon from a criminal?

I see what you are saying, but lets be honest, if getting pulled for RAS of illegal tail light, why does that give the LEO a RAS for the firearm owner to use the firearm against the LEO....:uhoh: (Sorry if I didnt use RAS correctly I hate acronyms.)

EDIT: Add the fact that, he handed him a CCW... isn't the whole thing about a CCW/CHP that pretty much says the government trusts you to posses a firearm...... and yet they are allowed to take it away during a traffic stop. That needs to change.

Well, if you say there were never any factory stock Firebirds sold that way in Maine, then you must be right.

Of course that Could have been imported, and then the stock Trans Am lights put on after inspection.... who knows?

There's no actual statute that mentions tinted or dimmed tail lights, but there is one around "reflection levels" of those lights, which is what they use to get you. I'll find them tomorrow if you'd like. We just covered this a few weeks ago in class.

I'd almost be willing to bet that the Maine code is similar to Georgia, which is written - -
O.C.G.A. 40-8-23 Taillights
(a) Every motor vehicle, trailer, semitrailer, and pole trailer manufactured prior to January 1, 1954, shall be equipped with at least one taillight mounted on the rear, which when lighted as required in this article shall emit a red light plainly visible from a distance of 500 feet to the rear.

As red is a tint (insofar as translucent materials) all that is required is a light of sufficient brightness installed as OEM. The problem, as you've noted is that most people who 'smoke' their lights probably don't pay enough attention to know they need brighter lights (or don't care:cry:)

edit: although I cannot locate a Maine specific entry, every other state seems to use 500' feet as the metric for visibility.
edit 2: Page 6 of Maine Vehicle Inspection Manual states: "Factory smoked signals and clear lenses to the rear are now permissible." NB it is in the "Class C changes section" for whatever that may mean.
