So, I've noticed that Crabtree Vally Mall doesn't have signs. Are we good to go and OC in there or are we looking at having a situation like the OP?

There have never been signs. It's a mall policy and you will be harassed for it. I wouldn't advise doing so unless you really want to get into an altercation.

If its not posted.. then its not off limits...they have to post the sign in a conspicuous place.. .if its just simply "policy" and its not communicated to those who patronize the mall.. then they dont have a leg to stand on.

Their only other option would be to walk up to every person open carrying, inform them they cannot carry at the mall, and give the person an opportunity to remove their fire arm or themselves.

I personally think we need an open carry event there. Kinda hard for them to arrest a large number of people open carrying there. Strength in numbers.

I did notice however the OP didnt want something done by anyone about this.. so maybe that wouldnt work...but it would serve this particular police agency right!

Ive always been a little concerned about dealing with a company police agency too.. just for a reason such as this...

I forgot to mention this before, but this was my second visit to this mall in several years.

So when I first noticed the lack of signage when I went to purchase something at the gamestop store. When I went to return the item, I parked at the same entrance because that was how I knew where to find the store again, that's when I OC'd thinking it would be posted if they didn't want firearms right? I mean they had a no smoking sign on the entrance.

I've only been back once since December. That was Tuesday to retrieve my property with a letter from the judge.

I paid a lot of attention as I drove in, passing several entrances that were marked. I don't think any of the "anchor" stores, which lead into the main mall are marked, and not all of the main entrances are either.

So they've got a nice trap set up there when you think about it. You enter, unwittingly violating a POLICY, but not any law. They take notice and approach you. You then must show them any ID they ask for, or risk spending the rest of your evening (and following 5 months) the way I did.

Maybe they would have found something to arrest me for even if I HAD shown ID. My dubious trust of them upon first impression has been confirmed.

Congrats "Smith". Good to hear that the case was dismissed, and you got your illegally-stolen firearm back...

I hope everyone reads this and "gets it" with regards to voice recorders.

Ooof... Sorry you had to go through this, Smith... Just plain ridiculous, and also why I don't OC much (apparently not enough, if this is what happens)... Thank you for posting, though.

I get it now, Dreamer. I get it. I wasn't completely on the recording wagon... but sure am now. Unfortunately, that back burners any chance of me OCing soon.

Sounds like you handled the interaction well, and calmly. Too bad the thugs caused this to be a 5 month saga. As the Skidmark thread in Virginia has taught me, justice may prevail, but it will be expensive and time consuming.

ultimately answer to him.
A call to his office from your attorney may "ding" Crabtree's file and force the agency
to properly train their sworn officers.
He is a fair man, sticks up for his people, but does not like headaches like this case sounds like.

As far as Qik, there are two problems with it. When the phone goes into standby after recording has been started and phone in hand or shirt pocket, recording stops. So one would have to prevent the phone from going into standby once the recording was started. Secondly, even though it does upload to the Qik servers, if one is having to keep the phone from standby, then access will be gained by a LEO in possession of the phone once confiscated and in 2 clicks video deleted from phone and server.

I love the idea of using my Evo w/ android to start some type of audio recorder and have it record and upload even in standby and will continue to research this to find a usable program. Audio instead of video would use less space and less battery.

Never thought about stby or lock mode interrupting my Qik app. So I tested out your theory - I made sure my phone settings was lock on one minute. I started uploading live. My phone stayed on and never went into stby or lock. Doesn't seem to be an issue Qik stays on uploading if in a cell reception area.

I agree if I have Qik set for live upload and your not in a cell phone reception area the video could be delete by crooked cop since the phone can't upload without a signal.

I just checked my Voice recording app on my IPhone and it does lock after a minute, the phone keeps recording so that works ok.

I have an IPhone 3G.

The voice recorder I have on my phone prevents the phone from going into standby.. However I can push the sleep button and it will still record... Combined with a lock screen... Nobody will know its recording.. and It should keep recording till turned off of battery dies... I like this set-up better than my actual VC... Way more secure and one less thing to carry

Qik has the handy and convenient delete button right in the recording interface... They don't even have to figure anything out to destroy that evidence you just collected...

It seems like a great recording app as it streams concurrently with the recording. If they would get rid of that damn delete button, or at least require password fro deletion, it would be perfect.

As it is, it just makes destroying evidence even easier for them.

My fault as I thought I had mentioned speaking from an Android phone. I've never touched an iPhone so I can't speak for them but tested on my Evo, as soon as I hit record and the phone goes into standby, the phone stops recording.

For Android Users I have come across 2 programs that have mostly positive reviews and should take care of the job:
1) Free - Tape-a-Talk Voice Recorder
2) $4.26 - Audio Recorder Machine

I'm liking the Audio Recorder Machine over the Tape-a-Talk personally.

That makes sense, it was a good observation though.

I learned my IPhone doesn't lock with Qik running. I hope the IPhone 5 works better, I'm still waiting to upgrade later this year when it comes out.
