Wowwie!!!

Quick Update on Advanced America. Had Corporate call me back from my email I had sent them and he apologized for the inconviences at that location and the lack of signage however he did inform me that they do not allow open or concealed carry on their property and that he (was the district manager) would make sure to have that store along with all the other local Advanced Americas put up signage to that effect.

I suppose that leads me to the question of is it legal for them to BAR CONCEALED carry on their private business grounds? (Aside from them asking you to leave) If I was to ever return would I be able to legally carry concealed (pending what they dont know wont hurt them)? Would that even be legal? I assume it would be legal, please correct me if im wrong.

You are our noobe protaginasts... ask for signs,,, now you got them,,, thanks!!!

I most certainly appreciate the advice! There are always going to be things I can (and want to) learn.

I am a little fuzzy on the liquor license aspect tho. Would having it in my vehicle, properly stored be considered "possessing"? Also, I hadn't seen that statute anywhere or read it on any of the threads or blogs I have looked at. Obviously I know about not having it at a bar or a business whose main income is the sale of alcohol. It is disappointing to hear that 85% of the places I will shop at (Meijer, WalMart, Grocery stores etc.) would be off limits without a CPL. Would this include a hotel? I frequently travel for business and am in and out of hotels in the Detroit area...

I am certainly getting my CPL however, I am moving to Detroit and need to be able to OC in my vehicle and to be able to walk to and from my truck/residence without having to go to the back, open the case, load...etc. Thank you for the information, it was very helpful.

Side note; I did pick "her" up last night from Gander Mountain and they were wonderful! Very helpful, answered every question I had, encouraged OC and cleaned her for me (free of charge!).
One more time... READ THIS!!!

http://forum.opencarry.org/forums/showthread.php?113518-Open-Carry-without-a-CPL

read ALL OF IT. Pay special attention to the liquor license part of it .. and realize that all that is needed is the license .. the business doesn't have to even sell the stuff .. all that is necessary is to have the license. BE CAREFUL!

One other thing... without a CPL you cannot be in "possession" of your pistol inside your vehicle!! You cannot "open carry" inside your vehicle!!!......... Also .. when transferring your pistol from case to holster......do NOT touch or handle your pistol within the confines of your vehicle! Take the case you legally transported the pistol in completely OUT of the vehicle... then take it out of the case... load it .. and holster it COMPLETELY OUTSIDE OF THE VEHICLE!... reverse the process to put the gun back into transport mode. Do NOT even so much as reach back into the vehicle to get a jacket or something after holstering so that the gun breaks that imaginary line from "outside" to "inside"... because... without a CPL .. it is illegal to possess a gun "inside" the vehicle in any manner other than in transport mode.

As far as having your pistol property stored in your vehicle in the parking lot of say... Wal Mart that has a liquor license... being in violation of the "premises" part of "possession"..........

That has been debated many times and as far as I personally know... no one has yet to provide a definitive answer as to whether the parking lot qualifies as "premises" under the liquor law or not. Perhaps someone will provide such an actual cite and/or link to actual facts concerning that issue. In the meantime I personally would suggest not taking the chance since getting caught screwing up means prison time. But then, as with all things, you get to decide what you will do.

But before you decide what to do................ READ THIS!! Then READ IT AGAIN.. AND AGAIN!!!
http://forum.opencarry.org/forums/showthread.php?113518-Open-Carry-without-a-CPL

It might appear that I'm being a bit of a jerk.. but such is not the case. I'd much rather annoy you than to hear you have been arrested. So... DO NOT OPEN CARRY until you fully understand all the laws... and how those laws interact.

my ASP Baton

According to Davison PD, Flint PD, Burton PD, and Michigan State Police its legal as long as im not doing anything questionable with it (as far as brandishing goes or threatening random people with it for no reason).

The first thing we teach people around here is to NEVER EVER ask the police for legal advice. 1) They likely don't know the answer 2) If they don't know the answer they will likely give you their OPINION and pawn it off as the answer 3) No matter if what they tell you is completely opposite of the actual law they have no liability. Meaning you can't go back on them if you followed what they told you was legal and it turns out it WASN'T legal.

MCL 750.224

(1) A person shall not manufacture, sell, offer for sale, or possess any of the following:

. . .

(d) A blackjack, slungshot, billy, metallic knuckles, sand club, sand bag, or bludgeon.

. . .

(2) A person who violates subsection (1) is guilty of a felony, punishable by imprisonment for not more than 5 years, or a fine of not more than $2,500.00, or both.

Since a bludgeon doesn't seem to be defined in a statute that I could find it is possible that the courts would use a common dictionary definition.

http://www.merriam-webster.com/dictionary/bludgeon

a short stick that usually has one thick or loaded end and is used as a weapon

Now I know you'll argue that an ASP doesn't have a loaded or thick striking end but the above definition, from a common and respected dictionary, states that it is USUALLY that way. Which means it doesn't HAVE to be that way to meet the definition. Pretty flimsy argument to risk a felony charge over in my opinion.

Obviously I know about not having it at a bar or a business whose main income is the sale of alcohol.

See, there's the problem. You are reading the laws a CPL holder must follow for CONCEALED carry. There is a completely different law that a non-CPL holder must conform to.

MCL 750.234d

(1) Except as provided in subsection (2), a person shall not possess a firearm on the premises of any of the following:

(a) A depository financial institution or a subsidiary or affiliate of a depository financial institution.

(b) A church or other house of religious worship.

(c) A court.

(d) A theatre.

(e) A sports arena.

(f) A day care center.

(g) A hospital.

(h) An establishment licensed under the Michigan liquor control act, Act No. 8 of the Public Acts of the Extra Session of 1933, being sections 436.1 to 436.58 of the Michigan Compiled Laws.

(2) This section does not apply to any of the following:

(a) A person who owns, or is employed by or contracted by, an entity described in subsection (1) if the possession of that firearm is to provide security services for that entity.

(b) A peace officer.

(c) A person licensed by this state or another state to carry a concealed weapon.

(d) A person who possesses a firearm on the premises of an entity described in subsection (1) if that possession is with the permission of the owner or an agent of the owner of that entity
.

is it legal for them to BAR CONCEALED carry on their private business grounds?

Completely.

Not entirely sure what you meant by this, hopefully not sarcasm? :/

He means that it's better to assume someplace is OC friendly and just carry there (as long as it's within the law). If they're adamantly against OC they'll let you know but the majority of the time nothing will be said. We've found that many many times when people call to ask if OC is allowed they are flatly told "NO" and suddenly signs pop up.

Just to clarify, I didn't request signs.

In a round-about way you did. You contacted management and told them you didn't see any signs declaring their policy. Their thought process was then "Fine, you want to see a sign we'll put up a sign."

Just to clarify, I didn't request signs. In the email to their corporate office I pointed out the fact that there was no postings anywhere in their building or outside of it saying I wasnt allowed to carry my firearm on my persons. It was sort of a shocker when I was told otherwise today. I've been in there so many times now, I assumed it had been alright.

I do read the forums, and I noticed a lot of people who OC tend to write complaint letters to corporate in regards to their policies. I can assure you this business wont get 'MY' business anymore. Especially since I feel slightly betrayed as a loyal customer who apparently had been doing something 'against' their policy the whole time but it was never brought to my attention until recently.

You have a lot more posts than I do, however I feel you could have handled your responses a little better, especially considering im new here and I pose no threat to you or the OC community. Just doing my part and being an although new member, a member of open carry none the less. I fell the responses to the situation that had arised today on my behalf were a lot better than they could have been (had I decided to argue with Advanced America or the manager about policy).
In spite of what some may say, yes, some of us do complain to corporate HQ of various companies, asking what corp policy is. I don't know if anyone ever mentions not seeing signs or not. In the end, it doesn't really matter. You emailed, they responded stating that all carry is not allowed on their property. If I were you, I'd email them back, responding to their answer that you'd be sure to tell all your friends, so that we don't make the mistake of spending our money there.

In my opinion, the rest is this particular subject is simply baloney.

Now, back to the topic at hand. Friday I OCed at the Leslie Marathon, Leslie General Dollar, Mason Meijer, and Mason Arby's. Today (Saturday) I OCed at the Fowlerville McDonald's, Mason Meijer, and Mason Meijer Gas station.

Well interesting morning for the wife and I. Some may be aware of the commotion in my area with Todd's Guns sponsoring a little league team down here. Todd's sons are on that team. The league had no problem but the coach and some parents did. Well, the wife and I got shirts from Todd's and showed up this morning for the game wearing them and our open carried hand guns. We were just past the gate to the field area when a coach from the other team came over, and said "Very classy, carrying a gun to a base ball game". I smiled, nodded , and replied "Thanks for the compliment" and my wife said thank you. Of course the guy was already walking away, having come over just long enough to try and insult us. Then a bit later while sitting in the bleachers a couple came over to sit. The woman got up behind us, started to sit, noticed our hand guns, and said to her husband "I can't sit here, sorry". So we had that bleacher to ourselves. Now the County Sheriff that was present and the Bedford Township officer didn't even give us a glance. Talked to a a couple other people who were concealed carrying about open carry as they new nothing about it. Those were pleasant conversations.

personally, i like people to let me know how they are anti self defense and into gun infringement. if you think about it , they may get more robberies and mass shootings if they advertise it. just because they don't have a sign don't mean they can't run you off.

maybe if you are anti constitutional they MUST put a sign up before they can say anything to you

It's not my business to try and tell you how to act towards people, BUT....

Why not be as clear as possible with the first answer you gave her, so there wouldn't be any dumb follow up questions.

Ex: "No ma'am it is not an airsoft, It is a real firearm. I carry it for self defense, and It is completely legal in this state to OC. **hand her a flyer** Have a nice day."

OC'ed all over Jackson this weekend, including:

Best Buy, Target, Olive Garden, Big Boy, 7-Eleven, Meijer, Denny's.

No issues. No comments. No nothing. As it should be.

Now the slightly off topic part:
Also, some friends wanted to go shooting, so we went to what we thought was a shooting range... but, despite the fact that the sign said 'DNR Shooting Range', the instructors must have been kindergarten supervisors, the way they were treating everyone. Never been to a DNR-run range, and will never, ever be back.

Didn't notice the gun on my hip at first but due to their 'all guns must be unloaded to enter the range' crap, they freaked when they noticed. Instead of asking me to unload it, they asked if I had a CPL. Still unacceptable in my opinion. If I had been there by myself I would have left at that point. [Well, had I been there by myself I would have left immediately but, still.] So, I loaded 'no more than 6 rounds at a time' in my G17 and proceeded to attempt 100yd shots '3 seconds apart' until I fell asleep.

OC'd while cutting the grass at the late mother-in-law's house on Saturday, then on to lunch at Brian's restaurant in Burton. After a good lunch, went to storage unit to dig out some of kid's summer toys. Finally went home and mowed my yard while OCing. Oh, my neighbor OC's too.

I open carried at huizenga park in zeeland with my fiancée and our kids this weekend. Had a great time with no issues. Also oc'd at dairy queen for dinner with my daughters after a day out. No issues or man with gun calls. We were there for about an hour and a half. Enjoyed our food and ice cream. Girls had a great time with daddy. After a while I believe people saw a dad and his babies having quality time, and relaxed a bit. Then the oh God looks turned into. "they're so precious" comments. Management clearly saw my sidearm and did not say anything. I recently went to Holland hospital and saw a weapons free sign. I hate going there now. Also went to a doctor appointment with my girl and saw the most detailed no weapons sign ever in grand rapids. Will post pictures when I can.
Carry on!!!

Out and about with Yooperlady today and I OC'd at...

Taco Bell in Clio where a veteran happened to be the next person to come in so he got the 5$ we left at the cashier just for that "next person"..... after getting his food he came to sit at a table near us to talk.

Well.. of course there will be those who will choose not to believe but according to the man's talk (NOT stories!) he saw quite a bit of for real action.... and he was glad to see someone actually exercising the right to bear arms... because he fought for that exact right.

I felt humbled by the sacrifices made by this man (and many more) just so I could eat a taco while wearing a gun.

Oh... other than the staff who think Yooperlady and I are really nice folks ...no one, not one.. none.. of any other customers gave even so much as a fart in the wind.. that I was wearing a gun on my hip right there in plain sight in front of God Himself and everybody.

Then off to Wal Mart for some shopping where no one really cared about my sidearm. No one screamed, no one ran away, in fact... I can say with quite a bit of honesty... no one, not staff or fellow customers, exhibited any signs that they gave a crap at all.

Then we stopped at Beacon & Bridge gas/convenience store at the junction of M13 and M57 to fill up with gas. A bit of good natured "pass the time" banter with the staff and none of the other customers so much as making any indication they even noticed later I had paid for the gas and was on my way.

And all of that is exactly as it should be in the United States of America where the 2nd Amendment protects the right of the ordinary person to wear a gun.. and despite the best efforts of the main stream media to paint gun owners/carriers as terrorists the general public still knows the difference... much to the consternation of the elitist politicians who think they own the United States of America.
