What the F&*% are you waiting for now Judge Kennedy?

MacDonald v. Chicago is quite clear. Make the only ruling that you can Judge. It reiterates the bright line that states can only regulate in sensitive places such as schools and government buildings. (P 39-40 of court opinion if you are a slow reader). Strike down the carry ban, it was, is now, and will remain unconstitutional.

Why does Judge Kennedy collaborate to deny US Citizens of a civil right?? Hey Kennedy, maybe you should exchange your black robe for a white sheet!

Shame on the Judge, and shame on the Chief Judge of the US District Court for Washington, DC for letting this case be delayed for far too long.

My guess is we should see this decided pretty soon. Kennedy was probably waiting for some kind of guidance from the McDonald decision. He has to know his decision will be appealed; by Gura if our side loses, by DC if they lose because they're dumb and don't care about wasting taxpayer dollars for a futile case. I don't think the typical anti-gun decision just stating McDOnald/Heller didn't hold public carry of a pistol will hold up. He has to do better than that.

Alito notes several times that self defense "in the home" was NOT the limit of Heller - merely the paramount place of exercise of the right. I'm thinking this is in fact clarification of Heller - in which case DC will be collectively ******** its pants as they tear out their hair.

This is good to know, and SCOTUS has apparently been watching the gyrations in Washington DC, and offered this tidbit as further protection and clarification not only in Heller, but also in Chicago.

What's the time limit a Judge can delay a ruling? 1 year?, 20 years?, no limit?

I don't know that there's a specific time frame, however, once a ruling drags on and on I think the other judges on the court start asking questions and will put pressure on the delaying judge. He can't stall much longer now that McDonald is decided; he has all the guidance he needs right now.

How sad it is that six months after oral arguments we still do not have a ruling about a gross infringement of a fundamental right?

Judge Kennedy has been too busy to rule on whether the phrase "bear arms" really means bear arms.

Wake up and smell the coffee judge. Stop procrastinating and make your ruling.

It's almost a year since the case was originally filed. He must be trying to figure out a way to rule against us but make it look good so the circuit court doesn't call him an idiot when they get their chance.

This is the judicial form of a pocket veto perhaps.

Judge Kennedy sure is dragging his feet. The ruling is going to be appealed no matter who wins at the district court level, so all this LONG delay is doing is clinging to the status quo for as long as possible. I sure hope none of the 5 pro 2A Supreme Court Justices die before this is settled.

I want to OC in DC so bad I can taste it. It is, after all, a fundamental right.

they are not prey to the upstanding residents prowling the mall when they wish to visit their representatives.
This would take a tremendous amount of thought as he is dealing with illiterate city council
and a violent congress, and well armed white house.

You try an word "shall not be infringed" into single syllable, no wiggle room, phrases that
can't be used in propaganda sound bytes by Shadow Sen Norton.

Yep, I am holding my breath for that one.

I thought that DC was going to have to issue permits to non-residents,not necessarily recognize out of state permits. The DC code allowed for someone who had a permit from their state to get one in DC(before DC made it so no one has authority to even issue a permit).
This case still drags on........

Easiest thing to do is declare DC a federal park in Virginia. Now you just need to obey VA carry laws while in the washington dc park system. Heck I believe in freedom, if you are so inclined you can declare that you are carrying under the maryland laws if you wish. But it should be the persons choice, not the governments.

Would also solve the whole statehood issue, as states have no claim to federal park land.

6 Aug is the one year anniversary of the filing. Still no decision. I think we need an empty holster protest in front of the US Federal District Court in Washington, D.C. to emphasize that the foot dragging is being watched.

I've been thinking myself what could be done to hasten a ruling from Judge Kennedy. I feel quite powerless against a Federally appointed judge who does not have to answer to or stand for election by the lowly masses. Perhaps we could start contacting sympathetic members of the House and Senate and ask them to apply whatever pressure and influence they have over Judge Kennedy.

Does anybody know how we research the cases of particular judges to see how slow they are?

I would surmize that the plaintiff's attorney's would be the logical entity to prod the judge. If they aren't pushing the issue themselves (might not be part of their strategy, or in their immediate best interest to do so) then we might just have to wait.

Happy one year anniversary

It has been a year since law abiding citizens have asked for relief from over reaching and unconstitutional laws within the District of Columbia.

Shame on Judge Kennedy.
