(b) Any person aggrieved by any refusal to issue or renew a permit or certificate under the provisions of section 29-28 or 29-36f, or by any limitation or revocation of a permit or certificate issued under any of said sections, or by a refusal or failure of any issuing authority to furnish an application as provided in section 29-28a, may, within ninety days after receipt of notice of such refusal, limitation or revocation, or refusal or failure to supply an application as provided in section 29-28a, and without prejudice to any other course of action open to such person in law or in equity, appeal to the board. On such appeal the board shall inquire into and determine the facts, de novo, and unless it finds that such a refusal, limitation or revocation, or such refusal or failure to supply an application, as the case may be, would be for just and proper cause, it shall order such permit or certificate to be issued, renewed or restored, or the limitation removed or modified, as the case may be. If the refusal was for failure to document compliance with local zoning requirements, under subsection (a) of section 29-28, the board shall not issue a permit. (CGS 29-32b)

The statue does not limit an appeal to be filed w/i 90 days .... it says "may" ... not "shall" ... I do not see any cases wherein after 90 days, the BFPE is without jurisdiction. It may be so, I just cannot find a case. Also, the "after receipt" seems to limit the 90 day jurisdictional time period to only those cases where they provide a written response to the applicant.

When an application is denied, the applicant has the right to appeal the denial to the Board of Firearm Permit Examiners (the "Board"). Conn. Gen. Stat. § 29-32b(b). .... http://scholar.google.com/scholar_case?case=3412775830444234950&q=29-28a&hl=en&as_sdt=8006 Kuck v. Danaher ....

Hence my thought of having the OP get something in writing that they are still working on the application ... then, once obtained, he could then write a letter to the issuing authority and advise them that he considers the lack of providing a permit upon the last set of communications is seen as a denial based upon the lack of producing a permit and demand that they issue the permit w/i 7 days or an appeal will be filed. It would be simply covering his Ps and Qs.

To start off this my first post. I live in NC hold a NC CCW. Applied for the CT. permit in June got it at the end of October. Whole thing took 4 months, I had given up when it showed up.
Good luck with the process.

Finally Got it!!

After only 7 months and 3 days, I finally had my 60-day temporary permit. I still probably wouldn't have it if it weren't for the help I got from Ct Barfly. With a lot of his guidance, I was able to make a few calls and emails to the right people and I was able to find where the snag was. A little pressure there and the problem was suddenly solved.

After understanding how the system works, CT Barfly is right. If you are experiencing an unusually long delay, do not reapply and do not file an appeal. It will only make things worse.

Hello all, first post on this site. Lots of great information here, and it has definitely helped already. Somewhat disheartening to read the delays in Milford as I was planning to finally apply for a permit after I take my gun course on Dec. 7th. I was hoping the fact I am an attorney with a clean record (and recently went through all those background checks for the Bar exam in CT last year) would possibly help with expediting the process, but it doesn't seem like that is the case.

In any event, for the purpose of adding to this thread I will update it with my progress in the coming weeks and months. Nice to see that CT gun enthusiasts have a supportive community.

don't hold your breath. like rich says, stay on top of your dates.

milford is a particularly egregious offender if you ask me...so make sure you do all the right things during the process.

That is what I thought. Having a NC CCW ,CDL, Haz-Mat endorsement, and TWIC card. Which all include a FBI, TSA,Homeland security check and fingerprints. My NC renewal took 1 week. Even with the feds. on my side it took 4 months.:banghead:

Still waiting

Well I'm still waiting it's been 11 weeks today and still no permit. I was told that the delay was due all the assault rifles having to be registered. All my local resident trooper could tell me was it should be sometime in January. He said they are still waiting on my fingerprints to come back. I called Middletown and asked if they had been run and I was told I would need to check with my resident trooper. When I asked the resident trooper he said I needed to check with Middletown. I do know it took over a month for my checks to be cashed. I can understand a slight delay but this seems to be taking much longer than it should.

How long has your appeal been in for?

They have a book of excuses !

File an appeal of you'll be waiting 2 yrs for your permit.

I contacted Middletown again today and they were very helpful. They stated my fingerprints were E-Mailed back to the town yesterday. So I'll give it a bit more time before I file any paperwork. They did state that they received my fingerprints the third week of November and were backed up.

DO NOT RESTART YOUR APPLICATION.

Personally, I see no reason to appeal when there is a delay. Rich, don't bother quoting and objecting...I know where you stand.

Revocations and denials, sure...delays...it's just sitting on someone's desk among coffee stains and pizza slices. It's up to you to make it someone's business to get the ball rolling again.

The first point of biz is to identify which entity is responsible for the delay. Call the state, call the FBI (hint, it's NOT the feds), call your town. Figure out where your paperwork is and whose responsibility it is to get the stuff moving forward. The statute is only OK at making sure that various entities do things in a timely manner, but there are cracks...and in one of those cracks is your application.

PM me if you'd like some assistance.

I'm just going to start re-posting my advice every time Rich B tells someone to appeal in response to a delay by the state/town. See Reply #84 for a success story.

DO NOT APPEAL IF YOU HAVE NOT BEEN DENIED.

But one HAS been denied. An administrative denial but the law sees it as a denial.

Hi all, this is my first post. I just started the application process on Thursday 1/9 with the PD in Rocky Hill. I went in on Thursday to pick up the paperwork and happened to be going during the hour where they do fingerprinting. I provided my money order payments and did the printing on the same day I was picking up the application. I am going to be filling out the application this week and hopefully bringing it back before the end of the week. Based on all the information I am seeing on this site I will be documenting all the dates very carefully. Does anyone have any experience with Rocky Hill and their processing timelines?

Thanks,
Mike
