So Kentuckiana Pride is coming up and I was hoping to attend the festival this year OCing and in my Pink Pistols shirt to try and stir up some interest in starting the local chapter back up. I know Kentuckiana Pride has a ban on firearms, but I'm not sure they legality of it.

I cannot determine, definitively, if the Belvedere is considered a public space or not. I know groups can reserve the space for events and charge admission, but I am unclear on what the law is on carrying during such events.

Any help would be appreciated as I'd like to approach event organizers with as much information as I can.

It looks to me like it's owned by Louisville, though they seem to take pains not to make that evident.

Yes BB62, the Belvedere is public property. You and I OC'ed there together during the "World Fest" a few years ago. That event charged no fees for admission. However, if the Belvedere is leased for a "private business enterprise" the lessee can make their own rules. To me, a "private business enterprise" requires an admission charge. No money, no "business" and, certainly, no "enterprise". Concerts, where there are admission charges, are held on the Belvedere and other parts of Waterfront Park regularly. These are all "no weapons" events. Our preemption law prohibits local governments from regulating guns. It says nothing about public property and nothing about a private entity, like Kentuckiana Pride, using public property. The important part is WHO is doing the prohibiting, not WHERE it is being done.

With all of this being said, I can't guarantee that the people in charge of the "Kentuckiana Pride" event are as well informed as you have just become.
It seems to me that then the $64K question is "Is there an admission charge to Kentuckiana Pride?"

And, maybe it would be worthwhile for an interested party like Ahareht to do a public records request for the permits, lease, contracts, etc. between the Pride people and the Metro government. What say you?
