It is absurd to defend an obviously unsafe act. First of all, a "law" has no meaning if it is not enforced. The most recent stats I can find, say that 38 states have passed anti- "texting while driving" laws, but nobody seems to be enforcing those laws, and you don't get the full appreciation of preoccupied drivers unless you ride a motorcycle. I have had three instances where "cagers" have blown red lights because they were either looking at their laps, or they had their cellphone centered on their steering wheel. Had I not been paying attention for all the other drivers, I would have been killed (please hold your applause). About two weeks ago, on my way to a doctor's appointment, I stopped at a traffic signal beside a car with a young woman in it - she was busy looking at her lap. The light turned green, and when she finally began to move I was already about 100 yards ahead of her (driving at the posted speed limit, and without smoking my tires). I insured that I stayed well out of her way.

I can see no sensible reason for engaging in any potentially deadly activity while distracted (with the exception of participating in a war... where everything is a distraction). Driving is a state-granted privilege, not a right. Pax...

How does this relate to the long dead op? There is very little that would be done to a texting driver who harms, kills, or damages property. These incidents are more of a civil matter these days, unfortunately. Texting and driving, cell phone use, laws are nothing but a way to generate revenue for that jurisdiction.

Have you read the case law? I am not advocating for anyone to break any laws. A poster posted that a driving license was a privilege, I argued with case law that driving was not a privilege that traveling/driving was a RIGHT.

Kangaroo/traffic courts are not in the business of following laws, common or constitutional and they do not want to be exposed for the corrupt entity that they are therefore any motion framed properly arguing constitutional law violations and citing common law precedent will be quickly Dismissed.
Kangaroo/traffic courts are in the fine and fee business, they received these fines and fees from citizens that are ignorant of their rights and citizens that render authority to the quasi courts... Kangaroo courts are NOT in the LAW business.

Go sit in at a kangaroo traffic court some day, and you will be amazed at the lack of justice being forced upon the citizens..

If a defendant defends his case, the case will be heard at the very end of the day. Most people don't defend, most are sheep and plead down to a lesser offence. They humbly pay their fines and fees and thank the kangaroo quasi judge for stealing from them the fruits of their labor.. (sheepel).

I do not break any traffic laws, I follow and know the traffic statues/titles like the back of my hand. However I will not purchase a privilege/license and surrender my inalienable right to travel... YOUR RESULTS MAY VARY.. BE ADVISED ACCORDINGLY!

Conan Dan you don't need a license to actually register and insure a vehicle in all states. My state I run plates and it comes back with no license status. They get pulled over as owner/operator and usually go to jail unless some mitigating circumstances then I'll issue a citation and let then go. They can discuss the constitutionality of it all the way down to booking then while in booking. Haven't had a case get flipped for unconstitutionality. Actually had a guy serve 90 days recently on a suspended license violation.

As other have pointed out please do not follow the advice or the poster saying you don't need a license. He won't be bailing you out or paying your court fees.....

I have the driving wo a license charged dismissed and I pay the fine for the original violation, the violation say not coming to a complete stop at a stop sign.

You may own/register a vehicle without a driver's license. There is nothing in any statute (that I am aware of) that prohibits ownership/registration of a vehicle in your name. However, if you operate that vehicle upon public roads, you must have a valid state-issued or international operator's license. I believe you may own a vehicle without registering it or having insurance upon it, but without both registration and insurance, PLUS a valid operator's license, it is a violation of law to operate it upon public roads. (The preceding claims are based solely upon personal observation, training and experience in 11 states - I do not work for the DMV of any state, nor am I a LEO any more. :D) Pax...

(Chapter 7 - emphasis added), but, on the other hand, nowhere in the NJSA (that I could find) does it specify that you must have a license to drive (if you have had one somewhere at some point in time) NJ.PNGLooks like you must have had one (once-upon-a-time) and just chose not to renew it. Previous possession appears to be a "Get Out of Jail Free" card!

And here I thought I had seen all the stupid loopholes. Congrats - you found the absolute, all time, winning loser law! NJ has some really goofy offenses - totally unrelated to moving violations - that can cause your license to be suspended or revoked though - like "grafitti", or "Snow or ice falling off moving vehicle", and "Failure to signal before starting" (WTH is the signal for starting your vehicle)?

Thank you for your reply. Yes and yes to your post.. I did posses a valid DL back when I was 17, many,many moons ago. Also there was a time when a citizen could posses a license from multiple states if a citizen cared to do so, now the tyrants only allow you to contract with one state... How ironic... They have something called "The National Driver License Data base". Similar to the IRS master file data base..
