I remember Packing.org had on their state license map about portland ME restriction on open carry and will not allow it, Im a mass resident and likes the state of maine a lot, I go to Portland and I hold a ccw license for maine but I still open carry everywhere even here in Massachusetts.

does anyone know anything about this restriction?

See if you can hunt up their city ordinances with your search engine.

While the folks on this forum are generally a good bunch, weusually recommend against accepting verbal input on laws, ordinances, etc. We have animplied rule that statements about law require acitation at minimum. Quotes and links to go with the citations are best. The consequences of followingerroneous advice are too steep.

Your question inadvertantly, and quite innocently I'm sure, essentially asks someone else to do the research for you.

If you have trouble locating it, just ask back. There will be plenty of help, I'm sure.

If you have the money for a good lawyer go right ahead and OC, I will tell you that the Portland Mayor is anti-gun and police there will try to harrass you for exercising your rights. Maine is not the free state it once was, too many people from away that try to shove their views upon others.

My Question is inadvertantly? when Im just asking the question on a topic that no one knew is an improper? it was only a general question and to say that you have animplied rule that statements about law require acitation at minimum, what does that really mean? You just want people to already know the answer to the question they are going to ask? It seems like I'll just view other peoples question and points and keep to my self, sorry to be a bother, I got this site mixed up with packing.org, got a lot of imput from that sight but I asked a lot of questions in order to.

No offense intended. We just gently steer folks towards looking up things for themselves. Sort of a gentle nudge in the direction of taking personal responsibility.

I've seen some way off-base comments in my time here. I recommend not to trust a thing anybody says about the law until you have looked it up yourself.

We have a little tradition here we call the "penalty flag." Anybody asserts a point of law without at least citing the exact statute or court opinion, and somebody either politely asks for the cite, or throws a penalty flag. It arises from the unwritten rule about cites.

Cites are minimum, quotations and links are best. Heck, just give a cite alone, and sure enough some smart aleck will come along a few minutes later with the quote and link and some comment intended to rib the fellow who left them off.

Maine's Constitution, Article one section 16 states, "Every citizen has a right to keep and bear arms and this right shall never be questioned." Sounds like the founders had a good idea how they felt about carrying a gun.

Portland's unenforcable ordinance :

(a) No person shall have in his possession in or on any street, way, sidewalk, park or other public place, or in any motor vehicle on or in any street, way, sidewalk, park, or other public place between the time of sunset of any day and sunrise of the following day any loaded BB gun, air gun of any kind, gas pellet gun of any kind, firearm of any kind or description or any other such weapon. (b) This section shall not apply to any law enforcement official in the performance of his or her official duties or to any person defending himself or herself or his or her property. (Code 1968, § 703.6; Ord. No. 155-72, 5-15-72)"

And of corse this :

The adoption of title 25, § 2011 in 1989 rendered invalid many local ordinances regulating firearms. See, e.g., Hilly v. City of Portland, 582 A.2d 1213, 1215 (Me. 1990) (holding that section 2011 preempted a Portland ordinance prohibiting the carrying of guns at night). In addition to affecting regulations by cities and counties, section 2011 preempts firearms regulations by municipal agencies or authorities. See Doe v. Portland Housing Authority, 656 A.2d 1200, 1203-04 (Me. 1995) (finding that section 2011 preempted a municipal housing authority's leasing provision which prohibited the possession of firearms on the leased premises).

This was added to Maine's constitution 21 years ago after the state supreme court nullified the states older RKBA provision, so the constitution was amended to nullify the state supreme court ruling which said there was no RKBA under the Maine state constitution.

You live in Maine and you don't know about this? I thought it would be common knowledge...

The case was State v Friel in 1986.In 1987, the constitution was amended to nullify this court decision. That is why Maine's language today is as strong as it is.
