When Sgt Grabolski met me in the lobby, I handed her my firearm still in holster. She put it into the armory while we had our meeting. During the meeting I gave her a copy of the state preemption law. She said she was unaware and had never seen that law and would forward it to the legal dept.

My opinion is that the legal department doesn't care what the law says because the pre-emption law has no teeth. I am curious if anyone has any experience with the writ of Mandamus procedure... I would like to get a writ to force the State Police to issue me my permit since it has been over 30 days, and I would like to get a writ to force the City of Portland to stop enforcing it's illegal rules and erase the illegal laws.

I don't know what they have against you. I was let in with my firearm to meet with her.

You should get other residents around to shut down the station...what do they need a station for - they should be out working.

Well not a real police station, but...

I swung by the Air Base in Bangor today and met briefly with the Chief of Security Police there.

He told me to just inform the gate guard I had a fire arm and leave it in the car when I visit the BX or Commissary, etc. So now if one of the "troops" gives me some static I can tell them to call their Chief to get the real skinny.

I'm guessing my MAINEiacs Retiree hat might have helped things along too, that and the fact I used to ride with the former Chief on patrol. :banana:

The whole point is that I went proactive in making first contact.

Airmen have nothing to fear from marines ... that's why they let you carry. :D

See they still have KC135's in service there ... nice 50 yr old aircraft ..

What marines Dave? Its an AIR base where I retired from. They're all Air Guard folks, but maybe the odd Marine is in there who jumped the fence.

Yeah 135s and they just transitioned to R models. If the mechanics didn't do such a great job keeping those old birds air worthy and sparkly clean maybe would have got new tankers by now.

Orono PD has a sign that says "no firearms or weapons beyond this point" it is on the entrance door. I noticed this when I went to apply for my CC permit. I will be fighting this soon due to the preemption law. Any advice on fighting this. I will be going to take a picture in the morning then email Capt. Ewing about this. I am new to Maine(about a month) and am already invested in the fight. I have been a long time reader on the CT OC board but never posted much. I also have done a ton of work in changing the policies of PDs in CT for OC and pistol permit requirements.

Good to know. My first contact with the department was throught the "contact us" form and Capt. Ewing responded. I will see what his response is and go from there. If the Chief needs to be contacted, i'm sure he will be told of my e-mail, or if the Mayor needs to be contacted. This will be fixed however. I should've done more research on the department's administration, dropped the ball slightly. However, Capt. Ewing is a good man and officer and should sort this out. Will keep everyone updated. I'm sure I will receive some type of response when he gets in this morning.

I was wondering if you were aware of Maine's preemption law, MRSA 252-A? That states no municipality shall enact stricter firearm's laws than the state. Based on this statute, your department cannot ban firearms inside it's doors. You do have the right to ban all other weapons except for firearms. I would like to work with you on changing this. I don't want this to be taken as an accusation that your department is not complying with the law on purpose. I know several other stations were unaware of this and have fixed their signs to correspond with the preemption statute. Under Maine law the sign currently holds no weight as per current law only "liquor establishments that allow on site consumtion" are allowed to post no firearms signage. Thank you for your time. You have been helpful in the past and I hope this email does not infringe on our "relationship".

Might have suggested a link to the law, but I'm sure that he or his councilor will find it.

I tend to be more succinct: On (date) I saw.... the statute is.......please advise me how you intend to correct....I may be reached at.......and I thank them in advance.

You quoted the statute number wrong. That's the chapter, but it's not really that useful for finding the statute. The Statute is Title 25 Section 2011. Otherwise I think it looks all right.

Thank guys. Sorry for the statute misquote. It aspirated to me looking at the MRSA thats what the statute number was. Is much easier to read CTs CGS statute numbers. I remember this for the future.

Just received my response from Orono PD's Capt. Ewing. He thanked me for bringing this to their attention and promised it would be fixed. I asked him to respond back with a plan of action and to let me know when the problem was corrected. will keep this updated as it goes along.
