Police say a robbery suspect was shot dead by a homeowner during a home invasion in the Lawncrest section of Philadelphia.

The incident happened at 11:30 p.m. Monday inside a home on the 6100 block of Reach Street.

A 35-year-old man, masked and armed, barged into the house and announced a robbery to the five people inside.

"The 35-year-old entered the property through the front door, gun in hand, and announced the robbery," said Philadelphia Police Chief Inspector Scott Small.

Investigators say the 27-year-old homeowner took out his gun and fired at least four shots.


The intruder was hit twice and collapsed, dropping his handgun by his feet.

Meanwhile two women who live in the home had gone to get their own semiautomatic weapons.

"However, we don't believe those females fired any shots," Small said.

When police arrived, they found the 35-year-old on the dining room floor.

He had been shot in the neck and chest, and first responders were unable to revive him.

Investigators soon discovered nearby what appeared to be a half pound of marijuana, packaging materials and several hundred dollars.

"There's a very good possibility in this home invasion-robbery that the motive was to steal this narcotics-related money," said Small.

The five people in the home were taken to Philadelphia Police Homicide Division headquarters for questioning.

Phiily has liberalized their marijuana laws. Small quantity for personal use is a minor fine $25 i believe. The quantity in the article is possibly the reason for the home invasion. That being said I am glad to see that the owners defended themselves. The question I have is are the handguns legally owned? Philly police have been getting better about armed citizens but they still do not like OC. As per PA law in a city of the "first class" you must have a LTCF to OC.

Summery of the laws:

While Pennsylvania has a specific law that requires a License To Carry Firearms for the concealed carry of a firearm, and the carry of firearms in vehicles, the law is silent on the legality of openly carrying a firearm in other situations, making it de-facto legal.

There is however a law that requires a License To Carry Firearms to carry either way in "cities of the first class", which as defined by law is only the city of Philadelphia.

18 Pa.C.S. § 6108: Carrying firearms on public streets or public property in Philadelphia
No person shall carry a firearm, rifle or shotgun at any time upon the public streets or upon any public property in a city of the first class unless:
(1) such person is licensed to carry a firearm; or
(2) such person is exempt from licensing under section 6106(b) of this title (relating to firearms not to be carried without a license).
To summarize, open carry is legal in Pennsylvania without a License To Carry Firearms except in "cities of the first class" (Philadelphia) and vehicles where a License To Carry Firearms is required to do so.

Regardless of what one thinks of drug (or any other) laws in this nation or in any particular State, there are some lessons to be learned here.

1-Engaging in criminal activity may well increase your odds of ending up in a bad situation. As some here post, "Shun icky".

2-If you ever need to use deadly force in self-defense, expect a fair level of scrutiny from the authorities. Dead bodies demand it. It might be prudent to give some thought to how extra-curricular activities are going to look when discovered pursuant to an investigation into how that body got dead.
