Pawn shop and my AR..denied pickup?

Was arrested for a Dui.. Plead not guilty.. With all the new financial issues that I'm facing, I got a loan on my AR-15..from the same Pawn shop that i bought it from. When i went to pick it ..i was denied after the background check. I have no felonies or domestic violence charges! Nor have i been convicted yet of this crime beings that my court date isn't till next week! WTF!!?

This question is going to seem harsh, but was the charge a felony DUI? If it was, then you cannot receive a firearm from an FFL, until the matter is resolved (other than with a felony conviction).

If it wasn’t, then I suggest you appeal the denial to the ATF. The FFL should have given you a card detailing how to go about the appeal, including the NTN for the NICS check. If the FFL did not, shame on them.

The FBI does make mistakes with denials. They made at least one involving our customers. Crazy story there, but this isn’t the place. This thread is about your denial.

That's why you NEVER deal with FFL dealers.

Next time , get a loan from a family member or friend and let them hold the AR till you pay it back

Hey..thank you for the reply.. No it was not a felony Dui .. Gross misdemeanor.. First offense. My attorney said there should be No reason why i should have been denied. I know that they are constantly doing things with the whole gun laws and restrictions.. Semi auto, assault rifle, large capacity magazine.. Bunch of crap! But like i was saying..I've never had a felony not have i had a violent crime.. But ya..i hear you.. Got that little card.. Need to go get my finger print thing and jump thru their hoops i guess..

The only advice I can give you then is to appeal the denial. Maybe your attorney can help you.

Likely some overzealous (or corrupt or incompetent) government paper-pusher put your name into a database he shouldn’t have. Or the FBI made a mistake. As I said, they do that.

I hope you can be compensated for any mistake that was made by a governmental agent. I doubt it though.

Make SURE you actually were denied. Cuz you shouldn't have been.

You wouldn't be the first to have a pawn shop tell a person they were denied , when they wetent ,kept the rifle and sold it later for much more than they loaned the person on it.

Well here's the thing.. He wouldn't let be take it cause he said i was denied but allowed me to pay the interest on the Pawn and repawn it.. They are a fairly reputable shop in town.. He even called the ATF while i was there because so far this is the second time i was denied since i pawned it. He wanted to make sure it was ok to run my name again without having gone thru the appeals process. They said yes..because you only have so long to appeal after a denial and i failed to do so after the first. So this way..it kinda reset the process..giving me that timeline again..and i will be sure to jump on it this time..but ya.. I was thinking the same thing at first..that they were just raking in the interest from me..wish i could just call and find out what is keeping me from getting her back..bunch of BS!!

The FFL can run a second NICS check if you filled out another 4473. Running a check without a 4473 is illegal.

If you were denied twice, likely it was not a mistake by the FBI. Someone, somewhere entered incorrect information about you in a database.

I mean..i am the registered owner.. It is my property! I have done nothing that should revoke my right!! I feel as tho I'm a victim of theft!

That's because you are.

The whole ffl ,NICs, BC, ,garbage is unconstitutional, and therefore illegal.

Same as civil forfeiture.
But you are so far one guy vs the tyrunts.

Had a pawnshop that sold a stolen AK. Police came to the buyer and confiscated it. Pawnshop refused to refund the full purchase price. I told the guy to get a copy of the 4473 for insurance purposes. Two days later presented the pawnshop with a demand letter and attached to the letter was the 4473 containing the serial number of the AK and the police report, also, containing the same serial number of the stolen AK. The pawnshop immediately refunded the money plus tax.
