Open Carry in North Dakota - ND CWP Test Administrator

I've been a ND CWP Test Administrator for over 10 years. The clickable map and information sheet for the state of North Dakota is wrong.

From the ND state information on OpenCarry.org:

Summary: North Dakota is not a traditional open carry state. However, it is a shall-issue state that issues a carry permit that allows both open and concealed carry.

The ND CWP laws do NOT allow loaded open carry. The handgun or dangerous weapon must be carried concealed:

62.1-04-01. Definition of concealed.
A firearm or dangerous weapon is concealed if it is carried in such a manner as to not be discernible by the ordinary observation of a passerby. There is no requirement that there be absolute invisibility of the firearm or dangerous weapon, merely that it not be ordinarily discernible.

It is legal to open carry unloaded during daylight hours however:

a. Between the hours of one hour before sunrise and one hour after sunset, the handgun is carried unloaded and either in plain view or secured.

b. Between the hours of one hour after sunset and one hour before sunrise, the handgun is carried unloaded and secured.


North Dakota does have open carry permits but those are reserved for law enforcement and private security officers.

It was my understanding that 62.1-03-01 paragraph 2 subsection (a) stated that those restrictions were not applicable to those possesing a valid ND CCP or one from a state which honors ND's permit? That restriction being that open carry during the day be unloaded, wouldn't that mean permit holders could carry open and loaded?

/shrug.

The permit test adminstrator from whom I took the test several years ago stated clearly that the permit allows both carry methods, regardless of time of day and whatnot.
