Good luck from Kentucky. We wish you the best of luck. I for one know I will be following this case and praying for a good outcome. But I do have one question. Did they know that you were recording them? I ask because I just started to carry a recorder EVERYWHERE I go and wonder if LEO "acts" the same if they know they are being recorded? And what kind of recorder did you use? I ask because it had good sound quaility. Once again, best of luck.

I would expect so myself, you can hear him drop it near the end.

I am about to get myself a spycam that looks like an ipod shuffle. Only about $60 too which is about what you pay for a good voice recorder, but this way the cop would be none the wiser about it.

On Topic: Stick it to them dude. There was no call for what that cop did and he had you detained/arrested MUCH longer than neccesary even if he did have RAS/PC, which I think he admitted having a distinct lack of about 15 times throughout that audio.

Be sure to ride that nice bike back into WY for the hearing! I OC on mine regularly too, some of the looks I get by motorists at stop lights are to die for.

Makes me wonder where this officer was raised and trained if he came from some anti gun state. My brother ran into this in AZ a transfer officer from CA thought things were the same all over.

He was informed that it wasn't and hopefully learned from it.

Good luck with your suit some times costing them is the only way they learn.

He asked me if it was okay if his partner was to draw down and keep a gun trained on him in order to shoot him if he stepped out of line. I declined and asked for a supervisor.

How is this every okay anywhere?

I could follow this up with like five more how is this okay questions, but this is the one that really struck me as ridiculous and one I hope the jury feels the same way about.

Ok, First I am pro open carry and recognize that some states do not require yhat you inform the officer, especially when open carrying, but having said that I believe we have the right to be paying attention, listen to the question and then anser that specific question with as little information as possible. A simple "yes" to the original question of whether or not you have any weapons, may have put this in a different like. If the officer approached you from your left side before you got off the motorcycle he may have not seen your weapon, and we have a responsibility to answer the question when asked, however if he did not ask then we have not requirement to inform, at least in the State of Wyoming. I will agree that the detention was extreme and in violation of your rights. His speech that his safety was more important that the constitutional rights of the citizens is BS. I not advocating the firing of the officer, but he obviously needs more training. Most LEO's respect that Open Carry or Concealed carry is good for the overall community and that as whole we are law abiding citizens.

Finally I think that your law suit is valid as previously mentioned due to the nature and length of the detention. It really sounds like he was aggravated by the fact that you were carrying and he was more concerned with his safety. There were several things he could have done to avert this escalating situation, including politely disarming you and securing your weapon in your own personal belongings but I am not sure that they can legally do that either. Under your theory we should just do whatever is ask of us wheather we have a constitutionally proctected right or not. Please re-think your stance on this.

Does anyone know if these officers are recent hires from out of state? It just doesn't sound like the way a normal Wyoming cop would act. I've OC'd many times in Wyoming no problem.

The court date has been set for 22 Jan 2013. That's roughly 1 year after the paperwork was dropped. I'll be sure to post more updates as they come.

Well Jan 22nd is Approaching Fast! Hopefully we will get some updates soon less than a week! Remember UPDATES!!!! UPDATES!! UPDATES!!!

If you do a quick Google search for 'Robert Pierson lawsuit' you'll find that the case was dismissed by a federal judge. Idiotic decision, and will now set a precedent for other cops, who've all been waiting for the green light to do this s#%^ regularly.
