On a 6-week out to AZ (30 mins from Tuscon) from VA... tips?

I'm out doing work right by the Mexican border probably 30 mins out of Tuscon and since I'll be out there for 6 weeks, I'm considering flying my firearm out with me. This is the first time I'm going to be doing this, so obviously I'll have to read up on all the TSA stuff very carefully before I do it.

Once I get there, I plan on carrying. I have my VA concealed permit so I'm already covered, but I'm just wondering what the atmosphere is like out there.

I've noticed on the handgunlaw.us pdf ( http://www.handgunlaw.us/documents/USOffLimitsA-M.pdf ) the places listed as offlimits are:
· Any establishment licensed to serve alcohol for onpremises consumption (e.g., a bar or restaurant, but not a liquor store or supermarket that sells alcoholic beverages in sealed containers).
· Any establishment or event open to the public where the operator makes a reasonable request for you to give them custody or remove the weapon from the premises. A sign would qualify for such request. By law, cities and counties are required to offer onsite storage if they ban weapons but not all are in compliance.
· The grounds of any public school, other than the parking lot. In order to be legal in the parking lot the weapon must be unloaded, and, if left in an unattended vehicle, such vehicle must be locked and the weapon out of sight.
· State universities and community colleges. Communitycollege parking lots are treated like those of public schools.
· Commercial nuclear or hydroelectric generating stations.
· Polling places on Election Day.
· Correctional facilities (this includes the parking lot of such facilities).
· Game refuges (except during an authorized hunt).
· You can take a firearm onto school property if you follow the procedure below.

The first two concern me because here in VA we have an open carry only in places that serve alcohol and it's not always clear which places those are (places such as Chipotle which serve beer but are at-the-counter fast-food type places). Also, signs carry no legal weight as far as I know and a verbal request would be the first such warning of tresspass.

What are the criminal reprecussions for carrying concealed/openly unknowingly into an establishment which served alcohol and/or a place where there are posted signs (such that I may have missed seeing the sign). Immediate arrest? Surrender of my firearm?

Also, are there any other suggestions or currently relevant events that would help make my 6-week stay a better one concerning 2A stuff? Thanks for all the help, and I can't wait to get out there... even if it's for work.

I'm afraid if you openly carry into an establishment that serves alcohol for consumption in AZ, you are subject to immediate arrest (assuming someone calls it in). I have mistakenly walked into such places and have had to make a discrete exit to remove my weapon and put it in the car.

I don't think the law actually addresses the gun owner. The restriction is on the establishment.

It's on both. But 1st offense for the carrier (if he was unaware of the law) is an infraction. Sorry no site. I read the law as posted on this forum months ago.

29. For any person other than a peace officer, the licensee or an employee of the licensee acting with the permission of the licensee to be in possession of a firearm while on the licensed premises of an on-sale retailer knowing such possession is prohibited. This paragraph shall not be construed to include a situation in which a person is on licensed premises for a limited time in order to seek emergency aid and such person does not buy, receive, consume or possess spirituous liquor. This paragraph shall not apply to hotel or motel guest room accommodations nor to the exhibition or display of a firearm in conjunction with a meeting, show, class or similar event.

30. For a licensee or employee to knowingly permit a person in possession of a firearm other than a peace officer, the licensee or an employee of the licensee acting with the permission of the licensee to remain on the licensed premises or to serve, sell or furnish spirituous liquor to a person in possession of a firearm while on the licensed premises of an on-sale retailer. This paragraph shall not apply to hotel or motel guest room accommodations nor to the exhibition or display of a firearm in conjunction with a meeting, show, class or similar event. It shall be a defense to action under this paragraph if the licensee or employee requested assistance of a peace officer to remove such person.

ETA: Never mind, I see it. If it had been a snake it would have bit me. Doesn't show what the penalty is though.

The key phrase to look at here is "knowing such possession is prohibited." There is a level of responsibility on part of both the establishment and the customer to know whether or not firearms are allowed. If a place is obviously a bar such as the word "nightclub/bar/cocktails" somewhere in the name of the establishment and signs stating "Must be 21 or older to enter" then carrying a firearm inside would likely be construed as knowingly violating the law. However, if you are simply going into a pizza place to pick up the order you phoned in 20minutes ago, don't notice anyone drinking, don't see any "no weapons signs" and have no reason to even assume they have a liquor license, I don't see how you could get in any trouble. In such a case, it is the responsibility of the establishment to tell you that weapons are not allowed and if they can't make that clear to "ordinary observation" they will be the ones likely to geta citation.

There are some 'bars' where you can leave your weapon with the barkeep upon entering... That used to be the case most places... but (sadly) less and less as time's gone by.

Generally... put it in yer glove box 'n lock it. No firearms on public transportation... near schools and the usual gummint buildings (including the post office). Other than that... OC anywhere permitted. (I check for the signs upon entering... ) Private property can set their own rules on that... and I'm OK with that. You shouldn't have any negative experiences. County Sheriff's 'n local Police KNOW the law here... 'cause OC has beenrecognized asa rightbefore AZ was a state. Conceled still requires a CCW/CWP or similar from AZ or reciprocity states. 'Same in New Mexico if you happen to wander that way.

hmm. curious, you mentioned public transportation. Are you sure about that? Reason I ask is that I've cc'd on city busses before and thought npthing of it. Hate tp think what woud have happened if I'd been "made".

i am moving down to chandler area in the next month.... is it true that after a month of being in arizona , i am considered a resident.. the reason i ask is, that means my idaho CCW permit is no longer good?? correct



if i remember correctly , out of state permits arent valid for cc byarizona residents while physically in arizona..

what i mean is that , as a resident of arizona, i have to have an arizona permit to CC in arizona.. hopefully i am making sense..lol

because while I OC about 80% of the time, I understand that there are times where OC is not practical. I CC at Church at work and on the bus. On the bus I do so cuz of the close quarters. I don't want some punk banger trying to show of to his homies by ttempting a grab. Not enough room on a standing room only bus to wrestle for my sidearm I'd just rather cover it. For the record I CC Arizona style. That is out of obvious sight. I coud care less if I print or if the wind exposes my gun after all, it IS AZ right.

Ya occasionally I hop aboard a Sun Tran express bus. Had a bus pass when gas was much more expensive and I was closer to the bus route. Lately though, I've pretty much been driving. I sooo prefer OC, it's just more comfortable. Hate to cover up unless I really have to.

I'm out in the cholla... No buses... 'cept school buses. 'Went to the gunshow at the Pima Fairgrounds yesterday... (the AZCDL table) 'n some guy outside said: "You ain't from the 'city' are ya?" :lol:
