NO you are using assumption, logic is based on fact, not guesses.

Oh, oh I can play this game too! I am making a logical assumption based on the reports supplied, while you are NOT using any logic from what has been posted. When it is stated that a gun is taken from a person (NOT from the ground) AND that the owner of said gun didn't draw the gun, then it is logical to believe that the gun was taken from the holster (where else would the gun be taken from if it hasn't been drawn AND has been taken from the person?). It would be illogical to think that the gun was picked up from the floor when there was never any mention in any of the posted articles about the gun falling out of the holster or being on the floor, along with the fact that picking a gun up off the floor is different from taking a gun from a person (as reported).

And now as you keep trying to state that the gun was on the floor and picked up I must remind you of this:

So please, just where is your cite to your claim that the gun fell out of the holster? I have provided my cite which states that the gun was both taken from the person and that it was never drawn, but your claim that it was simply picked up from the floor runs counter to it being taken from the person. Thus YOU need to provide your cite for such a claim. And no, stating "well X forum member said so" is NOT a valid cite.

I have a Fobus for my Taurus PT92, I tried another holster with a button release. I couldn't get good draws from the button release holster, it was one of those rotating holsters and would hang away from my body too far for my liking. The Fobus has slots to run a belt through, and is right against my hip. I get clean draws but it has great retention, adjustable with a screw. If I don't draw correctly, the gun won't even budge. But I've since overcome that, and continue to practice.
