When I drove through NC I was aware that I must OC, so I either had it on my hip OC'd or if I got uncomfortable I would lay it on my back seat. I put it on the dash for about 5 miles and it just didn't feel right. I don't think I liked the idea of passing motorists able to see my pistol.

I don't mean to come off as an idiot, just legitimately curious if I could have gotten in trouble for having it on my hip. I drive through NC to SC to see my family about every 6 weeks.

get a box...cheeper and takes the guess work out of the situation especially since you can't OC in SC...:banghead:

Don't even get me started on SC carry laws. :banghead:

I come down I-95S in Richmond to I-85S, then proceed into SC via I-77S through Charlotte. My parents live in Rock Hill, SC, where I grew up.

Sometimes out of boredom I'll switch it up a bit, or I'll take I-77N to I-81N and drive through the mountains on the way back to VA if I'm more concerned with staying sane than fuel economy.

second, as has been stated previously, ad nausm, on this subforum, NC has no specific regulatory statutes covering how to carry any un/loaded firearm in a vehicle. (see cite below: Section III D, pg 22) the AG's position is 'officer safety' is paramount. as such, laying the firearm on the seat or anywhere in plain sight is one perspective used. it could be perceived by the nice LE stopping you, if you firearm is on your hip, it is concealed and therefore you must immediately notify and proffer your CHP.

You do not need to unholster your firearm, nor do you need to place it in a box, nor do you need to place it on the dash. Leave it be in the holster. If/when the LEO decides that you need to step out of the vehicle, then YOU MIGHT WANT TO let him know that you are OCing a firearm. That decision is completely up to you because at that point you have broken NO LAWS IRT OC.

Thanks for the post. This is precisely how I understood things to be, and although I might buy a "box," I'll probably just continue to wear my pistol in my OC holster.

sorry Baghdad, i am not sure where you dredged up the concept 'if the firearm is visible TO ANYBODY IN THE VEHICLE it is therefore considered OC'd ' so you are good to go...nowhere in a just completed extensive search of NC statutes or the NC AG's overview does it mention anything about this concept! in fact, here is what the NC AG states in the reference i provided:

IMHO Baghdad, there is just something about having a firearm strapped to my hip, under my seat belt strap, next to the center console that seems to just meet the intent and spirit outlined by the AG's comment of 'covered or hidden' within easy reach of an occupant of the vehicle.

The way I see it once they put the barbers cape on you are no longer open carrying because at that point it is concealed, much the same as sitting in a car with it holstered. Can anyone elaborate on this?

But you are not in a public place, but inside the barber shop. If the barber (proprietor) is good with it, then john law can wait outside.

Before I was an OC'er we would lock the pistol in my tool box on the way to the range, but since I started OC'ing Ive kept it on my hip.

As solus said NC doesn't address the issue specifically, so I OC on my hip with no worries and I hope I'm never on youtube getting dragged out by an idiot, but all interaction with the PD so far has been a non-event.

Stopped in a different from usual Wal-Mart the other day, just had a few things to grab. Noticed the late teens looking skate boarders out on the sidewalk on the way in, then found them again asking the deli counter lady about making a pizza. Half listening to the conversation and I hear the one guy "woah dude, I can respect that!" Didn't hear friends response, but then he says "naw man, not the pizza, HER!" and points to my S&W. Then right back to discussing pizza.

Aside from that, been a quiet time here in Cabarrus county. Took a trip up to Va to visit family, carried everywhere except Sat night, we were going out drinking so they stayed home locked up.

Lowe's Foods, Dunkin Donuts, CVS Winston-Salem

First post on this forum, really glad I found it!

Carried today and yesterday for the first time while running some errands. CVS, Lowe's Foods, and Dunkin Donuts on Peter's Creek in Winston Salem. Pretty receptive overall, just got a weird look or two from some people in the grocery store, and overheard someone saying " . . . yeah, I know, as soon as I saw it." Other than that, I heard a few others talking about my gun behind me in line at Lowe's and Dunkin, the latter was "Well, it says 'Smith and Wesson' on the mag!". CVS was pretty deserted when I went in, but the staff seemed very receptive. Stopped for gas at the Hess/Wilco at the intersection of Peter's Creek and Silas, and they all were pretty receptive as well. The clerks were talking about a girl that got robbed in the parking lot the night before, and were ok with me carrying. Overall, I would carry at all these places again, nothing that seemed too out of the ordinary for me.

In NC the recommendation is that the gun be visible on the dash, or on the front seat or console. Every recommendation I have heard is that on the back seat is considered concealed. The state law is rather ambiguous, only stating the gun be visible, if it can be access by driver or passenger, and ultimately is going to be what the LEO that stops you considers visible.

Then of course, you need to do something else with the gun the moment you cross the NC/SC line.

I had issue with this too. I tried putting it on the front seat, but it slid too much, so I just kept it holstered so that the sights and rear of the slide were visible. In the seatbelt covers the rest. OC'ed over the weekend in Wake Forest.....Snappy Lube (got the "big eyes" from three twenty-something women in the lobby, but no commets); Bojangles; Wal-mart.............saw a guy on a Harley OC'ing a 1911 on Capital Blvd. in Raleigh on Saturday night.
