after reading the previous op ed"opinion" piece from 4/5/10 it is no wonder the mail tribune is know for shoddy work.... they fail to realize that their first ammendment rights are ONLY guaranteed by our 2nd ammendment rights.

if the trampling of mr pyles rights can be justified with good intentions, i hope they will recognize those same good intentions when the police come and confiscate the printers, computers and personel for the good of the community.

I, uh, thought this was America, where they couldn't take your property or treat you like a criminal until AFTER you've committed a crime... or at least I used to think that, until I got hit with a restraining order based on lies from my soon-to-be-exwife and they took all my guns away too. So, like anyone wrongfully accused, I fought it in court, only to have the ex turn on the waterworks, clinching the whole thing in her favor, and now I'm Brady'd for at least a year until I can get the R.O. removed, then a court to restore my civil rights.

What happened to America? It used to be common knowledge that you can't legally punish people before-the-fact, and can't strip peoples' rights from them (not to mention their legal property) on the basis of what they COULD do, but ONLY on the basis of what they'd actually DONE. Not to mention that you used to have to PROVE that someone had done something before you could restrict their rights, not just merely testimony, but evidence.

Things must have really changed from the way my parents taught me things worked...

Sorry to hear that happened to you. It is truly sad when a commonly used tactic like restraining orders decided by a mere preponderance of the evidence (civil court) can take away god given rights.

Exactly right - although I guess that this means they're not god-given rights, if they can be stripped away so easily and without ironclad proof of anything at all...

Mr. Pyles is being extremely quiet (AS ANYONE SHOULD BE WHILE MAKING A CASE or when they are the subject of a case) on the media front and the local newpaper, Police, and City Council all seem to be on the same page "didn't do nuthin wrong".

I do know that there has been a legal fund set up at Oregon Firearms Federation and I highly suspect that he's working on a civil rights violation case or some such.

There are several people who are considering making in person complaints to the City Council (while open carrying) at a public meeting. I am one of those but am trying to get word from Mr. Pyles that it wouldn't affect anything he's working on. (as soon as they circle the wagons, the gov't will say "subject of an ongoing investigation" and information on what they had (didn't have in this case I'm sure) and such will be "unavailable" because of the investigation). I don't want to be the one to trigger an excuse for them to avoid the light of day.

The local newspaper's reporting still baffles me. They made the FOIA request for the police reports, etc., received them. Prior to receiving the OSP report, they were skeptical about the actions of the police. After receiving the OSP report, they report all was done properly. Guess it is hard to believe a newspaper that has information putting law enforcement in a negative light would not publish it, or at least keep investigating...

i read of this event. it is absolutely cruel. taking the words of fear from someone who probably boned this guy right out of a job. handcuffing him, violating his rights left and right on the word of a politically correct sniveller. staking his house out, incredible. but you know, it can happen. mine didn't go as far, but it still went, so yeah, i can believe this case is real, and the cops are nothing more than sockpuppets of the politically correct nazis in our society.

You don't know if the news mediais investigating or if they are not. It is possible that unless the police or innocent man release more details there is no more they can investigate.

We can't bash cops in general as the vast majority are good people doing their best to protect us and as a society we do need them to do that. What we can do is demand that everyone (from the politicians that hire the agency head down to the officer that joined the force this morning) are held accountable for their actions. Weed out, with a heavy and painful hand if necessary, those that have violated their oaths to the Constitution. Hold those who violate civil rights personally accountable at a financial as well as criminal level. Make it known that the people, the ones who hire government agents, expect to be served rather than made into subjects.

The Pyles incident happened on March 8th. On February 2nd (a month prior) there was another incident that I hadn't even heard a peep about until yesterday. According to the new report I read,a Jackson County sheriff (a deputy) was involved in an incidentin February while working with a Ranger (can't remember if BLM, Parks, or Forrest) in which a family was basically attacked.

News report says that the officers rode up on unmarked bikes, openly armed but not showing identification. saying they were law enforcement (newspaper conjectures that their "ID" markings were probably covered by the riding gear and backpacks but isn't sure) and said they were doing OHV inspections. Then demanded ID and when the victim demanded that they PROPERLY identify themselves the officers refused and so the victim did as well because he didn't know who these people were.

Next thing you know he's been maced, face planted, and cuffed. When the wife demands ID she got face planted and cuffed.

Both charged with "disorderly conduct" - we all know why they use that charge right? "Cause there's no crime committed by the victims.

Now consider this...... You're out in the woods riding your OHV and come across a family in distress. Two unidentified but openly armed men are attacking the husband and wife. No where to be seen is ANY sort of identifying information (no badges, no stars, no vehicle markings, etc.). For all the person coming upon this scene can tell, armed thugs are attacking them for some unknown reason. Whether you immediately engage with deadly force (they are armed and violent), or you draw your sidearm (or rifle) and order the "thugs" to stop....... there is going to be gunfire and it's going to be tragic.

Either you will engage and terminate the violence only to find out that you've just shot two law enforcement officers when you do find ID on them...... OR ...... they are going to open fire on you.

It's time for a reality check within our public SERVice agencies.

I'm here in Medford and it's been VERY quiet as to any word on the case. It happened on March 8, 2010 and after a few weeks the paper stopped its biased reporting that was trying to paint the government as being "proactive" rather than that they had violated Mr. Pyles rights.

I can only hope that Mr. Pyles has an attorney and that a case is being prepared. I do know that a legal fund was set up for that purpose.

Proulx said upon reviewing the details, his training and experience led him to believe Pyles "was a threat to himself and or others." He amended the teletype at 9:50 p.m., sending out a second message that police had a reason to hold Pyles.

Medford police sent out the SWAT team and a negotiator just before 6 a.m. Pyles voluntarily came out of his house just before 7 a.m., was handcuffed, and agreed to point out guns and ammunition in his home so police could collect them, Medford police reports say. He was taken for a mental health evaluation at Rogue Valley Medical Center and released about three hours later after being cleared by a psychiatrist.

Same thing that Belle Meade Police, Tennessee Bureau of Investigations and Tennessee Department of Safety did to me. Belle Meade investigated me and said I wasn't safe witha gun. Manager for background investigations at the TBI said I was crazy and they needed to start an intelligence file on me. Tennessee Department of Safety says I am a material risk of harm to the public and took away my handgun carry permit. The only difference is they haven't raided my house and took me in for an evaluation, yet...

I wonder why this mental giant who was Pyles' supervisor and who thinks himself a pshrink, didn't offer any help to Pyles? He clearly thinks himself qualified to diagnose mental disease but offered nothing to Pyles, not even a quiet conversation. Does he feel no responsibility toward an employee of his who, according to his wisdom, has a problem? As big as ODOT is, I'm sure they could find someone to help.

they did find 4 local institutions to "help" him.... the Medford Police Department, the Jackson County Sherrifs Office, the Oregon State Police and the City of Medford.... we KNOW that they were ALL there to help Mr Pyle because the Mail Tribune has signed off on this....

i know i feel better now?
