Teen killed in attempted robbery, police still searching for a suspect

DENVER - Police are still searching for one of three people involved in an attempted burglary that ended with a 17-year-old being shot and killed.


They have another suspect in custody. The homeowner has not been charged.

It happened around 2:30 a.m. Monday at a northeast Denver home near Gaylord Street and Martin Luther King Jr. Boulevard.

Police say two 17-year-olds and another young man tried to break into the home.

The homeowner confronted one of the suspects and shot him multiple times in the head.

It's too early to tell if the homeowner will be protected by Colorado's Make My Day Law.

"You've got a situation where they breached the home, and then the homeowner took action against the suspects for breaching his home, that's how we understand it at this point in time," DPD Spokesperson Sonny Jackson said.

9NEWS is not releasing the name of the 35 year-old homeowner because he hasn't been charged.

Neighbor Larry James has known the man for 7 years.

"I guess the people were in his house, and he shot and killed them. It upset me and scared me, because it's close, pretty close and everything," James said.

The coroner's office identified the fatally wounded suspect as 17 year-old Marcus Duran.

Shortly after the shooting police took another 17 year-old into custody nearby.

"Right now he's being held under investigation of first degree burglary," Jackson said.

Police are still looking for another man around the same age.

Neighbors hope the shooting will make would-be burglars think twice.

"I think it does send a message to them, that you can't just enter a person's house that he worked for and everything, and I'm not going to protect my family. I hope it sends a message to them," James said.

With warmer temperatures here, police say the incident can serve as a reminder.

"Don't leave you windows unlocked, don't leave your doors open, be aware that there are individuals who will try and take things from your home," Jackson said.

Police wouldn't say where the suspect's body was found, but if it was found inside the home, 9NEWS legal analyst Scott Robinson thinks the homeowner will likely not be charged in this case, and will be protected by the make my day law.

Around 9:45pm on Monday night, family friends of Duran gathered in front of the home where he was shot and killed to hold a small candle light vigil.

Frank and Debbie Davis' son is close friends with Duran.

"I think that was pretty brutal. I mean, I can understand protecting your home, maybe shooting him in the leg, something like that, but to do multiple shots that's a little ridiculous," Frank Davis said.

"He was not a bad kid. He was in the wrong place at the wrong time with the wrong kids, that's what it was," Debbie Davis said.

Okay first of all... am I being mean to say that the candle light vigil would have pissed me off? I wouldn't have said anything... but.. a burglars friends all gathering outside your house with candle light and prayer? Ugh.. :uhoh:

Well.. glad this guy was able to defend himself. I'm sure glad to hear the "Make My Day Law" in the newspaper. I've only heard Good Things from our townsfolk about the deterrence of the Make My Day Law.

As for the quote from a friend "Why shoot multiple times?" (paraphrasing)... Well that's just awkward. How many shots were fired and how many landed in the target? I would double or triple tap because I know I won't hit on target every single shot. He practices the same- only he actually landed every shot? Or was it execution style where he shot the guy in the head- the burglar is not dead but wounded- and the home owner puts two more in his face to be sure?

I guess I can't judge this home owner for using more than one projectile to defend himself.

I was going to post about this last night then I thought maybe it was not appropriate to discuss on the OC Board, but I am glad someone has.

First of all, I am sorry for the homeowner that had to make this decision in the wee hours of the morning. It is unfortunate, but with that being said there should be no apologies for the action he took.

The famalies of the "victim" here if we should call him that as I feel that the homeowner is the vistim, acknowledge that their cousin, nephew brother or son, was probably hanging around with the wrong crowd but that was no reason to shot him. I am sorry but I say Bull$#!(. Had the tables been turned and they had injured or killed this homeowner, and then he was caught and they charged him with murder and the death penalty. Would they be crying the same tune and would the homeowners relatives be able to go after all the relatives for the wrongful death of this person, because we can see where the grieved family is going to sue the homeowner for the actions related to this poor kids death. The homeowner used the necessary force that stopped the threat and caused the other perps to flee.

I heard that the burgler was shot three times in the head. Kudos to the homeowner for being an excellent shot it this is true.

Finally, if the Make My Day Law is invoked and it is determined that this kid was infact trying to burglarize this home, then his family and estate should be barred from making any claim or suit against this homeowner since his death occurred during the commission of a crime.

May this be a lesson to others that may attempt a similar fate. Godspeed.

And if they tried to have a candlelight vigil in front of my home, I would hire someone to organize a large party with country music and everyone singing, ding dong the wicked kid is dead. Maybe I am cruel, but they need to recognize the their relative was a thug and on a journey to crime and punishment, and this homeowner has saved the folks of denver an expensive trail and incarceration....

Pretty sure the Make My Day Law protects from all legal recourse.

Still determining whether the Make My Day Law will apply? BS. Of course it will. It better. It is Denver, after all...

Shot him multiple times in the head? Damn... :)

The victim didn't shoot the intruder because he was hanging around with the wrong crowd. He shot him because he broke into his home which is also a threat to his life and property.

One great way not to get shot is to not go breaking into people's homes. I think the scum in societyare slowly learning this lesson the hard way. Every loser in that neighborhood will now have this on their mind each time they sit around considering ideas on how to burglarize and rob people. I think it will persuade a few more on what a really stupid idea it is.

One thing I have not seen mentioned was the 2nd teen is under investigation for 1st degree burglary. Now correct me if I'm wrong, but doesnt 1st degree burglary mean the accused had some sort of weapon. If that was the causethere should be no question that it was self defense; make my day law or not.
