Hello From Wisconsin!

I carry just about every day now, and am looking to come down to Illinois in the next few weeks. Just what is the law (in a nut shell) for open carry? How about in my car? As I am sure you know, in Wisconsin, we have a 1000 foot school zone, and no carry in cars, or bars. I have to load and unload every time I get in or out of my car...

So can I bring my gun with me?

There is no allowance for the carry of a loaded handgun for personal defense by any person Unless you have a valid Illinois Firearm Owner Identification card (FOID).

Even the FOID card only allows loaded carry for such on your own land or fixed place of business. For personal defense even FOID holders must carry unloaded and cased.

In Illinois open carry (loaded or unloaded) in unincorporated areas of the state have traditionally been considered lawful, but Continued changes in state law over the last 15 years have made doing so felonious under most circumstances. Under Aggravated Unlawful Use of a Weapon the exemptions are limited and self defense is not one of them.

Even possession of an uncased firearm in your hotel room or a friends home currently can be prosecuted as a felony in this state. Most counties would not prosecute but Cook County Has and the convictions have been upheld. Corrective legislation is on the Governor's desk, hopfully he will allow it to become law.

In a nutshell, You are limited to broken down in a non functional state or cased, unloaded and not immediately accessible.

Say, I guess I do have one more question. When did Illinois loose its carry rights? It looks like Wisconsin had open carry from day one, but we were to dumb toexercise it. Now we are fighting to get it to work out better (ie. school zones), it only took us 150 years.... So what happened in Illinois? You do know that we are in a race for a CCW. Still would not shock me if you get yours first though...

Maybe an Illinois historian can chime in but the slippery slope was the FOID card I believe passed in 1969. The most repressive were passed in the mid 90's and have been tweeked for the worse ever since.

The Criminal code of 1961 banned open carry in incorporated cities or towns, I guess that may have been the first step back. ( I am looking for my 1970's West's copy of the criminal code, I maybe wrong on the date)

I was permitted CCW for ten years and learned what infringed means, you have to buy your dispensation. Not again.

You are correct though Doug, I do not want to give up open carry to get our CCW.

Now if you keep this "child" stuff up, I just might have to take back my free dinner offer.;)
