SURPRISE -- Police officers arrested a man after he brandished a weapon and threatened customers at a store in Surprise Wednesday night.

Witnesses told police that a man made threatening statements to several customers inside and outside the Cobblestone store near Litchfield and Bell roads. Sgt. Mark Ortega said the man displayed a black pistol out of the driver's side door as he drove off the property.

William McDougle, 20, was stopped by officers a few blocks away and police located a black pellet gun made to resemble a 9mm semi-auto pistol in his vehicle.

McDougle was arrested and charged with aggravated assault, threatening and disorderly conduct. He was then transported to the Maricopa County Jail where he was booked.

no kiddin. Had i been at this wal-mart - it is conceivable that I would have returned his favor with a few 9mm "pellets" of my own....

Now, if he was in your face and pulled the bb gun and you did not know it was a bb gun, or he tried to run you down with his car, then it would be justified.

If I was walking in the parking lot and I saw someone point a gun at meeven from their car window, I would not hesitate to shoot. If it was real and he did start shooting, who knows how many people he can hurt/kill by the time police arrive. It may look like he is leaving the scene and that is all, but he still has the oppurunity to shoot while leaving. I know others may disagree with my opinion andI respect that.

There was a cop that shot a woman that was driving away from him, He lost his job, How do you think you would fair ? To shoot at a car that is moving away from you is foolish, you can take care of a immediate threat, but a retreating car is no longer a threat. I sugest you read up on AZ laws, unless you wish to become a jail house lawyer.

Back in the "good old days" in MO it was legal to shoot a fleeing felon.

I was working an off duty job when a larceny suspect tried to run over me with his car after I identified myself. Due to the cross traffic and pedestrians, I couldn't shoot. He ran over the toe of my boot ( that made it a felony) and after hedrove pastme I drew a bead on the rear car window. I had just had an orange insert put on the front sight of my S&W model 15 and I was admiring how it showed upunder street lights.

At 25 to 40 yards I fired 3 shoots, hitting a 1/4 inch above the crome strip around the window, the center of the crome srtip and the 3rd shot blew out the rear window and the rear view mirror. The suspect wrecked the car and was arrested.

The responding officers commented on the great grouping.

Shooting into a moving vehicle in a parkinglot like Wlamarts is not a good idea. If you hit the driver and incompacitate him/her, you then have a 2000 pound car rolling out of control, that could injure others.

But if I saw that guypointing his weapon at me or others I probably would have shot him.

she backed up and knocked the cops motocycle over, cops claimed she was trying to run him down.

no matter what, if a car is driving away from you and is no longer a threat, you should not even be thinking about firing at it. Call the cops and let them deal with it.

Some of them pellet guns and toy guns look so real nowadays. I ran across some pellet gun in a catalog I was browsing the other day and had to stare at it for a few minutes. There was nothing about it that didn't look like a 9mm pistol.

I have one that looks like a Desert Eagle. During baseball season I use it to shoot rats while I'm listening to the ball games. Bird seed on the ground attracts the rats...or they want to listen to the game too.

That's different in my opinion. Yeah I understand that the officer did believe that his life was at stake, but that is different than someone pointing a gun at you as they are driving by.

Ya that's why shooting a drive by shooter is against the law. After all, they are leaving the scene. :quirky

once you are out of his line of fire, your ability to shoot back is gone, he is retreating at that point and if you shoot you are now the aggresser.

The story said he was waving it, he was not aiming at any one person.

if someone is shooting at me from a moving car, then as long as they can shoot at me, they are fair game, but in this case, there were no shots fired, no one person singled out. To say you would shoot at someone because they were waving a gun as they were driving away is a good way to end up with a boyfriend named bubba.

You're conveniently adding details that just aren't there. The guy displayed a gun out of the window. It didn 't say one way or the other if he pointed it at someone. For all we know, he did indeed point it at someone.

As soon as he brandishes a firearm and I reasonably believe my life or another's is in danger, I have the right to defend life. I don't have to let him shoot first.
