I believe part of what prosecutors and judges are supposed to take into account before and as proceeding at trial is the likelihood of obtaining a conviction.

I'm thinking that in a lot of cases like these, it is clear that whatever the laws may technical say, a conviction is going to be pretty tough to obtain. None of us are keen on invasions of our privacy.

Sadly, the inconsiderate and entitled conduct on the part of some drone operators is probably going to result in far more government regulation of and limitations on drone ownership and operations than is really warranted to protect commercial and private aviation and personal privacy in the neighborhood. But as they say, "Behind every stupid rule is some dumb*** fool."

Federal regulators to require registration of recreational drones

Federal regulators said Monday that they will require recreational drone users to register their aircraft with the government for the first time in an attempt to track rogue flying robots that are increasingly posing a threat to aviation safety.

Against registration of recreational drone purchase and operation. A fan of downing a drone if it overflies my property.

I have a sign, made to be water resistant, on my roof, that informs a drone operator that the next incursion will result in the forfeiture of the drone.
