It is one thing for public officials to use a bully pulpit to educate and even intimidate the populace into a prudent awareness of basic sanitary behaviors — even those which go against our nature — to impede the spread of COVID-19. It is quite another to contend that their suggestions and intimidations and guidelines somehow have the force of the law behind them.

then mixes the metaphors between Fed/State and then refers to the founding fathers convention who discussed NATIONAL breakouts of Executive, Legislative, and Judicial...

your illustrious newspeek cite then in the a paragraph starts off by stating:,
"The same is the case for the states..." continuing with this HUGE leap of faith: " as each state’s constitution mimics the U.S. Constitution and mandates separation."

Then states this concept is Madison's sorrow...Madison, et al., of the founding fathers didn't give a rat's derriere about the states!

The founding fathers s provided the national government with powers it lacked and ensured national government would be able to act on behalf of the citizenry directly without going through the state governments. But the Founders also thought it important to preserve the states’ power over their own citizens.

Founding fathers left the state to develop their own Constitution to prove governance for their populace.

IMHO, based on reading of Article 1, section 8 is very clear...

PS: the nation's three branches hold the key for Commerce aka opening the country's economic stranglehold imposed by the pandemic...

Solus - governors may have power over their "subjects" but they still are not supposed to defy the Constitution. That crazy "female dog", Gretchen Whitmer, has gone WAY too far in threatening people with fines and/or sequestration for choosing to utilize their First Amendment rights to gather for Easter services. Just because a person's vehicle is in a church's parking lot does NOT mean they aren't taking precautions by spacing parishioners out and keeping the numbers small.
And Whitmer isn't the only moron who has overstepped their authority. I just hope and pray that it comes back to bite them (and their supporters) when the time comes. It may need litigation or, that combined with election defeat, to remove them to the dung heap of history.

majority of the States have 'state of emergency' clauses in their state's statutory mandates...IF any citizen believes/feels/ad nauseam their US Constitutional rights are being/were violated the time is immediately...cease and desist order in federal court...not after the fact with not reelecting the savants!

Constitutional issue? Quite likely.
The aggrieved citizen may also have standing in the state court as well as federal court, but said citizen will likely need to retain counsel at his/her expense to proceed, and a resolution could take a while. The government will be the respondent and has resources to sustain the fight. The possibility of being awarded attorney fees & cost if the plaintiff prevails, while not the objective, isn't much of an incentive to proceed with a lengthy suit, especially if s/he is out of work. And the court needs to be open for business.

The right, the power, the ability are all different

those in power have already exercised their real/perceived abilities to violate the citizen's rights...

the citizens capitulated.

durham nc county council just "decreed" citizens "to wear a clean face mask" are mandatory "when venturing into public spaces"... While face coverings are required, officials say no one will be removed from or denied entry to public transit for failure to wear a face covering.


no marches in the streets, courts were not besieged with writs written on tp, nada...all done in the closed confines by overseers!
