The temporary license has been issued. I'm waiting for a copy.

I now have an official copy of the temporary Class F liquor permit, application and the letter from the city of Dayton not objecting to the issuance of the permit.
The documentation supplied by the state does not address any limitations as it relates ORC Chapter 2923.

The file is just to large to post.

I have just received a copy of the police agreement for the event. Dayton was adamant that no lease exists for the event.

WOW, section 7 hangs the Oregon Hauntfest festival organizer. Oregon District Business Association is liable for any damages if the police harass or arrest open carriers.

The City is handing someone a lawsuit on a silver platter. And the City, the police and Oregon District Business Association have all been given notice about the issue.

Not trying to hard at all. Mr. Martin, president of the Oregon District Business Association holding the Hauntfest is trying to sell the idea that this is a private party. That the public streets are leased from the city. This is not true. He is also trying to sell the false idea that the Oregon District is safe. It is NOT any safer than any other place. He is also trying to sell his false claim that guns are illegal to carry in the Oregon district.

RCall is showing that Mr. Martin is blowing smoke about safety.

Well, after several emails to both Martin and city leaders there has only been little response by Martin, on Facebook.

When asked if the legal carrying of firearms would be permitted into the event Martin responded that there was a lease for the event area. We can only assume that he is making reference to 2923.126 (C)(3)(a).

Upon multiple records requests Dayton was adamant that no lease indeed exists. The only documentation they have is the police agreement.

Which says: "Except as provided in division (C)(3)(b) of this section, the owner or person in control of private land or premises, and a private person or entity leasing land or premises owned by the state, the United States, or a political subdivision of the state or the United States, may post a sign in a conspicuous location on that land or on those premises prohibiting persons from carrying firearms or concealed firearms on or onto that land or those premises.

Except as otherwise provided in this division, a person who knowingly violates a posted prohibition of that nature is guilty of criminal trespass in violation of division (A)(4) of section
2911.21 of the Revised Code and is guilty of a misdemeanor of the fourth degree. If a person knowingly violates a posted prohibition of that nature and the posted land or premises primarily was a parking lot or other parking facility, the person is not guilty of criminal trespass under section 2911.21 of the Revised Code or under any other criminal law of this state or criminal law, ordinance, or resolution of a political subdivision of this state, and instead is subject only to a civil cause of action for trespass based on the violation."

Home invasion, bank robbery or citizen being robbed on the streets anywhere in the Oregon District that Mr. Martin claims to be so safe is, in fact, no safer than any other city, town or neighborhood. You are buying Mr. Martin's rose colored picture of safety in that a criminal protection zone is justified even though Ohio law forbids it.

Pay no attention to that man behind the curtain, the great and mighty OZ has spoken.

Alright, three of us made appearances last night. We waited on the corner outside the event until 8:30.

Around that time one person in the group went closer to the gate and returned notifying us there are multiple large signs stating no firearms or weapons of any kind real or fake. Moments later we approached an officer close to the gates and I asked him if he could get a ranking officer to speak with us. He identified himself as a supervising officer. I introduced myself and I told him I assume you are aware we were coming. He confirmed he was aware in advanced. I asked him what exactly their legal grounds were for denying entry to folks while carrying. He told me it has to do with the class F liquor permit. I told him that I had a copy of the permit readily available on my phone and that the class F permit is not mentioned anywhere in chapter 29 of the Ohio Revised Code when it comes to firearm restrictions. It is the class D permit that is mentioned. He told me that's where the city and I see things differently. At some point another officer joined in the conversation. The officers told me that many of them support open and concealed carry. I asked them if I would be permitted entry with a firearm and was told no. I thanked them for speaking with me and stayed to observe them searching people and confiscating at least 1 toy firearm before departing.

I'm still puzzled at how the letter D and the letter F can be confused.

It was an F-2 permit. Here's where those are spelled out in the O.R.C.:

They close more than the road. They actually fence in several blocks. It's a condition of the permit.
