EL MIRAGE – Police took a man into custody who reportedly accidentally fired one round into the ceiling of a Walmart in front of several people.

El Mirage officers responded to the store located at 12900 W. Thunderbird after receiving reports of shots fired. When police arrived at the store the manager was standing with the suspect.

During the investigation, witnesses told officers 30-year-old David Walter, of Surprise, entered the store with a semi-automatic pistol in a holster. He would reportedly holster the gun and un-holster it as he walked through the store. Witnesses say the suspect ‘continually messed with’ and was manipulating the gun.

Walter was standing at the electronics counter talking to the clerk when he reportedly pulled the gun out of the
holster, removed the magazine and put it back in. The clerk got scared and said she was afraid he was going to rob her and notified the store manager.

Walter again allegedly approached a checkout lane and stood near several customers and workers as he pulled the gun from his holster. As he pulled the gun out it magazine dislodged and fell to the floor.

Walter re-inserted the magazine into the pistol and manipulated it as if loading it when the gun discharged.

The suspect was arrested and booked on six counts of endangerment, disorderly conduct and discharging a weapon within the city limits.

Do not continually change the carry method of your weapon, or draw and reholster it in succession. There is no purpose for this EVER. What an idiot ass.

Clean it and prep it.
Do a good function check.
Set it up for your condition of carry.
Place it in the holster, or your proscribed carry method.

The leave it the heck alone.

As we work to educate LEO on the rights of OC we must also work to educate the public on the responsibilities of OC. Until he actually fired the gun I am not sure what if any laws he broke However this one act by whatever you want to call him did more harm to the OC cause than 500 people walking around behaving themselves in the way we all preach about doing. He had every right to carry his gun into Wal-Mart just like any of us but why he chose to fiddle with his gun is another story. I don't buy the idea that he was a Brady plant intentionally doing his act but rather someone who knew his rights but not his responsibilities. As long as we promote OC and exercise our rights we have to remember that we are not alone in having those rights and others that choose to exercise theirs may not understand or be able to understand the responsibilities that come with them. The Brady Bunch, the Antis, the Sheeple or whatever derogatory term you want to use to describe them see all OC'ers as the same type as this fellow rather than the average member of this forum. It is part of our responsibility to educate everyone on safe gun practices if we want to keep our rights.

Otherwise we are as guilty of failure to do our job as the LEO who harasses someone on a MWAG call. And for my own information did the fellow break any laws before he fired the bullet? Also if he had not fired the bullet and had been arrested for something what would your reaction to his arrest be?

The gun going off was probably not planned but I believe some anti convinced this idiot to play with his gun with the intent of hitting the news in a timely manner relative to the Constitutional Carry bill.

Coincidences of this sort just don't happen. IMHO

In my opinion he was brandishing and should have been arrested whether it fired or not. The change in law last year that allows drawing a weapon was specifically written for actions of a reasonable person in defense of their or others lives. This idiot had no reasonable excuse for touching his gun much less drawing it.

I think the majority of us feel that if he had not handled the gun, there would have been absolutely no reason to harass him.

The act that would have me watching him at a minimum, is the constant obsession with fiddling with it.

Removing the magazine, then racking the slide? I mean really?

We aren't talkin about an AD while the gun was solidly holstered. The guy was messing with it.

I think the majority of us would be in agreement that you do the "manipulation" prior to entering society. Then you only "mess with it" if you intend to use it.

Here's the way I see it.

The anti-gun crowd has been losing ground badly for the last few years. Their message of "Less Guns = Less Crime" has been falling on more and more deaf ears, simply because the facts and statistics tell a completely contradicory story. The claims the Brady bunch make that those of us that OC are terrifying the rest of the public are unfounded. Their whole propaganda schtick is a lie.

So, if we the lawfull carriers of handguns won't provide the encessary proof that gun toters are irreponsible and intimidating, they'll just create/stage the scenarios they need to prove to the public that guns carried in public are a hazard.

It would be interesting to find out who this guys defense attorney is and what their history is concerning gun control.
