Can you carry this in NJ

I will be visiting NJ this week for a while. I will not OC because I do not wish to die or spend any time in jail.

My question is "Do any of you wear an un-weaponed (read empty) holster in protest of your denial of rights?"

Here in Washington State I wear a weapon ALL the time, therefore I always wear a holster. I will wear a holster(OC) my entire time in NJ unless I am arrested or shot. Your thoughts, as I am very interested in your opinions..

Tricky, but not worth it

Common sense would dictate that there is nothing wrong by wearing an empty holster, but you will be in NJ. I am almost cetain that you will be stopped, probably handcuffed, and arrested. If convicted, you will be able to start appealing this decision all the way to the Supreme Court which could take 5 or 6 years and cost you a ton of money. My honest opinion is that the US Supreme Court would decide in your favor, but the bottom line question is : WOULD IT BE WORTH IT?
It is probably best if you did not wear an empty holster while in NJ. Although this would take a lot of time, an organized event in which 100 people would show up to verbally protest NJ's draconian gun laws might accomplish more, although I am not even cetrain of that.
I wouldn't give up completely your idea of wearing an empty holster, but it would have to be thought out completely, planned to perfection, maybe even discussed with the Police beforehand about what you want to do, and you should be joined by others, not do it yourself.

My concern with empty holsters is that, without the firearm present, there is nothing to tuck your shirt/coat/whatever behind. If your clothing is hanging on top of or coming down over the top of an empty holster, it can look like a very poorly-concealed firearm, which could present a very real threat to your liberty and/or life in the People's Republik of New Jersey.

Can you cite the New Jersey law that would be broken if an empty holster was worn? I call what you wrote above fearmongering.

Yes, you can wear an empty holster and I'd encourage you to do so. There is no law against it.

Give me a break

To thebigsd in the great State of Virginia, and to MSG Laigaie in the great State of Washington: You are talking about New Jersey!!! Here are a couple of examples. 1.) A State judge ruled that a man who verified he was threatened numerous times still didn't provide a valid "need" to get a license to carry. This ruling was upheld. 2.) A disabled man was denied the right to get a hunting permit. This, fortunately, was overturned. A man moving here from out of State was arrested and jailed for having unloaded firearms that were packed in compliance with Federal law. After a long ordeal, our Governor corrected this somewhat, but I believe the citizen will not get his right to vote back. I could count on one hand the number of carry permits that have been issued in NJ. I apologize if it sounded like fear mongering, but I do believe you would change your mind if you lived here for a couple of years. Although I cannot cite a NJ law that would be broken, there are always "catchall" laws that any LEO could say this falls under. All I am suggesting is that we take baby steps to achieve our goals, especially in NJ. In numbers, there is strength. My original last paragraph still holds.

My question still stands. Can you cite a law that prohibits an individual from wearing an empty holster in New Jersey? No, you can not.

The fact remains that he may legally carry an empty holster if he so chooses. We could talk about what MIGHT happen until we are blue in the face.

Where I am from is irrelevant. We are in the habit of citing facts on this website. While we're at it, how about some cites for the examples you gave above?

How about a cite for when someone has been arrested for EHOC previously?

Well I walked around the Columbus flea market for a couple of hours on sunday with my brother in law. Unkle Mikes on my belt jacket tucked. Nobody screamed, no women lost there babies, I did not get arrested. A few people asked about it and why it was empty and I gave them a Washington States Gun Rights Phamplet. I carry them all the time. It was educational on both ends. I was not amazed that the people I spoke with fear their police, it was the extent of the fear that was troubling.

Well another day breathing, in the beautiful Garden State. I deedee mowe on thursday so the Family all went to lunch while the Prodigal was here. We went to an Olive Garden. Most people did not notice the holster on my belt. Those that did, smiled. No negatives, no worries. Great.
