Being drunk or stoned is no excuse for shooting people. Unless someone poured the booze or drugs down the perp’s throat, he took responsibility for his resultant behavior the moment he started to partake.

[And before someone asks for a cite, I am not saying that this is what the law is. I am saying that this is what the law, based on morality, should be (and I can’t imagine that it isn’t).]

Timeliness isn’t WHIO’s forte is it since the shooting occurred over two days ago.

Eye95, as for morality it is but a societal religious perception and who besides you truly cares, but kudos to his legal team for publicly laying the ground work for their client’s criminal defense...

“The accused alleges that he or she had lack of control over their actions, and, therefore, cannot be held responsible. The accused may have been deluded, incapacitated, provoked, severely mentally disabled or even have been sleepwalking. In general, they were in a state of mind in which they did not have control over their actions, didn’t know what they were doing or were unable to understand that what they were doing was wrong, or illegal. Many courts distinguish between insane automatism and non-insane automatism. For insane automatism, the court usually refers the accused to psychiatric, or other appropriate care. For non-insane automatism, the court either acquits the accused or gives a more lenient sentence.”

So what mate are are you trying to say, as is your current forum modus operandi, since you state in your initial thread post here, truly wasn’t what you meant to say or mean as outlined in bold above?

FYI, there are countries whose citizens strictly follow Shariah Law as defined by the Holy and Noble Qur’an and in 2014 Netanyahu promised Israel law will be based on and follow the Talmud!

Honestly I don't know of any excuse, save one ,and that's true insanity, for randomly shooting people .

There doesn't need to be a specific law against drinking and being armed since there is already a host of laws against shooting folks except in SD. Or in some specfic conditions to protect property.
