I am a Utah resident comming down to Aniston AL the week of 7/19-7/22 I have a valid CFP from Utah and am looking for a little more info to include a Open Carry pamphlet and some people to go out with who enjoy open carry.

I will be training down their and just want to meet some local people and enjoy my time away from work. I will be at the training hosptial their with FEMA.

There is a pamphlet available from the documents button on the main page. There is also a discussion forum on the site.

Basically, OC is legal for all who are not prohibited from possessing a handgun. No license is required except while in a vehicle. No carry within 1000 feet of a demonstration. Not all LEOs are on board with the law.

I have a question about that. The Baldwin County Sheriff's site makes reference to the section of the Code of Alabama regarding no carry at a demonstration, but states that:

"Your license does not authorize you to carry a pistol at any public gathering such as sporting events, political events, parades, etc. (Title 13A-11-59)"

Now, I've read Title 13A-11-59, and it doesn't say a thing about sporting events, political events, or parades. Just demonstrations.

It's not just Baldwin County... The NRA says the same thing in this Feb 2010 pamphlet: http://www.nraila.org/statelawpdfs/alsl.pdf

What is up here? Is there a court case where 13A-11-59 has been interpreted to include sporting events, parades, etc?

Considering that the law contains a definition of "demonstration" and that it clearly does not include sporting events, it is hard to fathom a court decision including sporting events in the ban. Doubtless, some ignorant sheriff misread the law or is creating his own "restriction." The NRA probably got its information from a similar ignorant source.

Someone who has the Baldwin CPL should call the sheriff and point out the error. Not that he'd be responsive.

That seems to be most likely... however, both sources are using the exact same phrasing: "public gathering such as sporting events, political events, parades"

So... I guess what I'm really wondering is if it would be possible to track down the origin of that phrase. It had to come from somewhere and it's easier to kill a weed if you target the root and not just the leafs.

Probably falls under the same misleading statement of "this license doesn't allow you to OC".
Obfuscation though truthful statements is a leo's best friend.

I just want some basic information on open carry in Anniston. Can it be loaded with my Utah CFP. Where can I have my firearm and where I can not. What is the local area like are LEO's friendly to open carry.

Maybe a pamphlet with open carry laws that will help me if I am stopped. My goal is first of all complete my training without being arrested. Thanks again for your help I look forward to visiting the great state of Alabama.

Well, one can expect the LEOs to be ignorant, uninformed, knuckle-dragging, "I am the law" types who will tell you things that are incorrect because they have no duty to inform you of what actual law is until they are explaining why they are arresting you... and if you're expecting the worst, then you will generally speaking have a better than worst experience.

I am not a lawyer, but my understanding is that the way that the current batch of cited laws and cases read, it is not illegal for a non-resident to openly carry a firearm in a place where he is allowed to carry a firearm by law. Of course, schools and school buildings is a touchy subject, as are state and federal buildings. But otherwise you should be fine. However some places, like The Galleria (big mall in Birmingham) are declared by management to be gun-free zones (yet the police officers don't follow that rule -- how odd?).

Therefore, there can BE nothing to be worried about. There's a magical sparkly barrier that SOMEHOW prevents all people coming in from wishing harm upon their fellow man.

Well, thank goodness we at least have that last thin line of defense between us and anarchy at the mall.

On the ATM tech OC'ing, call in an MWAG and when the PoPo come ask why, tell them mall management says no guns.

Sorry I haven't had much time to check the board much and for some reason I can't send pm to anyone, I have your phone number and will call or text ( if your phone is capable ) as for security and ATM tech Im trying to learn all I can about why their being armed in places that don't allow the public to be armed, I am myself a armed security and a little confused on the laws

I still OC almost everyday I just don't oc the weapon I carry for my job
