Judge Benitez has issued other well thought out and written pro 2nd amendment rulings.

They all have been shot down on appeal in the 9th circuit.

I believe his rulings are written for the supreme court.

Time well tell if any of them make it there.

I thought he did a really fine job of shredding the traditional arguments against AR15s. He really did pick apart their statistical rationale. But, then he said this (on page 47): "More people have died from the Covid-19 vaccine than mass shootings in California.". Without citation, which has already been disputed. His comparison of the AR15 to a Swiss Army knife has been ridiculed by the gun control crowd. No surprise there.

Let's hope that these issues are truly minor and that he's not letting his pen outrun his thought process. I certainly hope they don't hurt the chances that this will be SCOTUS case.

California's constitution does not address the bearing of arms. Even so, the federal constitution applies to California, specifically the second amendment.
United States v. Cruikshank, 92 U.S. 542, 553, 23 L.Ed 588 (1876):
The rights of life and personal liberty are natural rights of man. “To secure these rights,” says the Declaration of Independence, “governments are instituted among men, deriving their just powers from the consent of the governed.” The very highest duty of the States, when they entered into the Union under the Constitution, was to protect all persons within their boundaries in the enjoyment of these “unalienable rights with which they were endowed by their Creator.”
I think you know where I'm going with this.

The fact that the very liberal 9th would block the judges order was a "given". But, in doing so, they may have set this up to go all the way up and get a "national ruling".
