Another new bill, SB277, now exists, involving petitions for involuntary commitment resulting in a 3 year gun ban for the person the petition is against. The text is very confusing so I might have a wrong interpretation.

Actually, after reviewing the law and the bill again, I'm not even sure the bill does anything at all other than notifications and possibly allowing someone, after 3 years, to remove NICS records, because it appears one might need to be committed (thus restricted under 202.360 & 202.362 already) before the petition is relevant. But I may just be totally misunderstanding this.

I think I'll need to read this a few more times before I get it.

Another BDR became a bill.

AB340 - Modifies Uniform Firearm Regulation


The bill has a lot of good things in it... clarifying the purpose of preemption (Clark and even the State AG has basically argued that preemption laws currently existing are 100% meaningless,) strengthening the wording, eliminating the registration requirement in Clark County, destroying those records, and allowing people to sue if they are hassled over illegal local ordinances.

However, there is one part of it which is a bit bothersome:

This bill specifically allows for:
(d) The enactment or enforcement of a county zoning or business ordinance which is
generally applicable to businesses within the county and thereby affects a firearms business
within the county, including, without limitation, an indoor or outdoor shooting range.

So, basically, it sounds like if it passes, local governments will have free reign to regulate gun businesses of all types out of existence if they choose to, and probably Clark's 3 day waiting period will become legal. (As well as other rules, like ones prohibiting display of pistols in windows of gun stores http://library.municode.com/HTML/162....130WIDIPIAMPR )

Or Winnemuccas ban on a store having more than 500 primers in stock at a time? http://library.municode.com/HTML/167...8.20.030UNPOEX


And if they create a "business ordinances" which is "generally applicable" to a business, that sounds like it might also be applicable to an individual too. Would a county code like this be legal: "It is illegal for a gun store employee, or any other person, to carry a firearm in a gun store or any other public place." ? I'd hope that would be impermissible, but I don't know in practice how that would be interpreted.

Another bothersome thing is that the bill allows government employers to regulate the carry of firearms by employees. So if you work for the government and have a CCW, you could be forced by the government entity to be unarmed at work.

Upcoming Hearing:
Monday March 25, 2013 at 9:00 AM. This Senate Judiciary Committee hearing will be on 3 bills: SB137, SB223, and SB226. Room 2149 of the Legislative building in Carson City. Videoconferenced to room 4412 of the Grant Sawyer building in Las Vegas.

Also, BDR 15-931 has become SB396, which is a gigantic gun control bill. Assault weapons ban, private sale background checks, bullet ban, all wrapped up into one.

Check my table for summaries of these bills.

Maybe/maybe not.

Legislators do read it. I've heard them quote the tally numbers.

It does give them an "indicator." Of course it won't sway a legislator that is WAY left and has his/her mind made up already. But it COULD make a difference if a legislator is somewhat "on the fence."

Legislators can (and do) see the "vote" tally & comments for their specific district too.

I believe it is important to utilize the "share your opinion" feature.

MORE important is to email the appropriate committee and voice our support/opposition to a particular bill. And to attend (if possible) and testify in support/opposition. Call, write, fax - make our voice heard!

Extremely important hearing on Wednesday April 3 at 8:00 AM. First, the campus carry bill AB143 will be discussed. Then, AB195, the provision to allow early renewal of concealed firearm permits, and finally AB234, which is a bill to ban the possession of certain types of ammunition, as well as gun taxes, ammo taxes, and private transfer restrictions. This hearing will be held in Room 3138 of the Legislative Building in Carson City, and videoconferenced to room 4401 of the Grant Sawyer Building in Las Vegas. Assembly Committee on the Judiciary.

Tomorrow there are two "work session" hearings, one in the Senate, and one in the Assembly, for a vote on SB226 and AB195 respectively. As "Work Session" hearings, most likely the hearing will just be for discussion between members of the committee and for a vote. Most likely, no public testimony or public comment will be taken.

All bills that do not pass out of the first committee by April 12 will be dead. So far, only SB76 and SB18 have passed the first hearing.

SB226 and AB195 were both amended and passed out of committee. The amended text is not yet released. Also, SB221 is scheduled for a work session committee hearing (for a vote) on April 9. No Public Comment or Testimony will be taken.

William Horne may have been removed from the comitte for his blatant violation of the Rules of Ethics W/R/T SB231 in 2011, but it's very clear that he's still running the show. This jackhole has got to go. The same thing happened last session. Enough votes to pass committee, and even enough to send the bill to the Gov. but one mans bias gets to stand in the way of justice for the entire state.

SB226 amended text is now available and as expected, the provisions relating to preemption were amended out of it, so it no longer will retroactively apply preemption and end Clark handgun registration.
