“Maine CWP Training” is now Trademarked/Marked in the State of Maine pursuant to Title 31 M.R.S.A. §§1 & 2 for the sole use of Paul J. Mattson, Maine CWP Training, 101 Main St. Harrison, State of Maine and their authorized associates through July 25, 2022.

We found it necessary as individuals / business entities have been encroaching on our respected business for their financial gain.

Hmmmm, interesting.

How would you propose to proceed if someone uses the generic phrase in a published sentence i.e. "How can I get Maine CWP training?" or a thread titled Maine CWP Training that would list those offering such service?

Trademarks are relatively easy to get by claiming to be the first or only one to use the specific wording or symbol, especially when there is no one objecting. I do not see how you could claim exclusivity in this case however and do not believe it will hold up to a challenge.

If is was not a repetitive flagrant use I would let it pass. Serious infringements receive a Cease and Desist Order, web master and host receive state statutes enumerating their criminal and civil legal jeopardy as well...

Still puts a common enough phrase in the control of one at the exclusion of others - don't believe that is the intent of the procedure. See that as a serious defect here.

Now if you had trademarked the professional use of Maine CWP Training that would seem to be an entirely different matter - one that is easily appreciated.

So why the most recent steps? Violations of trademark is actionable.

Understand that at present it is a moot point, but like unnecessary laws it clutters up the landscape and unnecessarily creates problems for the unwary. ymmv
