Good Morning!

So I had an awesome run-in with the LVPD lastnight(05/10/17) and I wanted to share it with you all...

Lastnight I was able to get a sitter to watch my kids and allow me some free time. I was supposed to meet up with one of my old Marine buddies on the strip, so I grabbed my stuff (wallet, sidearm, ink stick, and leatherman) like I always do and just headed out. He was a no show, but instead of going home I just decided to cruise a bit and enjoy the free time I had.

I don't drink, I don't smoke, and I don't gamble... I really had no clue what I was going to do with myself, I just needed a break from my kids. I'm a stay at home dad with 3 kids, ages 10, 8, and 1.5.

I ended up driving around a bit and eventually just pulled off on a side street, parked next to a brick wall, and just hung out in the car in silence... No kids screaming at eachother, no yelling or fighting, just me in the car chilling out. I was able to reach out and give a buddy of mine a call, and have a conversation without any interruptions (so rare in my life).

Well apparently someone didn't like that I was just sitting in the car parked, doing nothing but sitting there. I ended up with 2 LEO's from the LVPD pulling up in their nice SUV's. As soon as I saw the first LEO pull up I knew they were there for me. The first SUV pulled up and the driver was eyeing me hard before flipping a turn behind me, as the second rolled up his spotlight lit up the car. I was in a car clearly marked with USMC Veteran plates, Pro2A stickers on the rear window, and my drivers window doesn't roll down. So as the second officer rolls up I opened the drivers door and put a foot out and made sure my hands were clearly visible.

The officers stepped out and said "that was far enough", and I responded "I just want to inform you I am a Loaded Open Carrier and my sidearm is on my hip, I'm making sure you can see my hands so we have no miscommunications" The officer responded "Its on you right now?" I said "yes sir", he responded "ok I'm gonna have you stand up, please keep your hands where we can see them" I stood up, the officer saw my hip and goes "ok" the other officer walked over and says "I'm gonna take it and put it on the hood" I said "ok" other officer asked "do you have any other weapons", I said "just the leatherman in my other pocket", he responded "ok I'll take that too".

After I was disarmed they asked for ID, I asked if I could retrieve it from my back pocket, they said sure. The second officer mentioned that someone had filed a complaint about a "suspicious" vehicle parked on the street making people uncomfortable. I said no worries I understand, handed them the license and disabled veterans ID I had on me.

They asked what I was doing, and I said "Honestly, I have a sitter and I just wanted a break from my kids. I'm a stay at home Dad and its just nice to have a night off. I didn't want to pull into a park and look like a creeper so I figured an empty side street next to a brickwall where I could just relax in silence was ok" the officer chuckles, says "I understand, and there is no law against that. He then pointed out that Officer 1 was just verifying I didn't have any warrants out or anything else to cause any alarm", I said "no worries, I understand", and we started chatting a bit, we talked about my time in the Corps and my deployments, the second officer asked if I was injured over there. He thanked me for his service, I thanked him for his. I mentioned I have family who are LEO in California, we chatted about CA a bit. His wife is from a part of CA not far from where I was from. It was basic chitchat you'd do with anyone who was friendly and you struck up a conversation with.

After it was verified I wasn't a felon/no warrants, and I wasn't breaking the law, they shook my hand said they wished more people were like me and were understanding of the stops and checks they have to do, and said have a good night. They allowed me to retrieve my stuff from my hood and they headed off to do what they do.


I gotta say all in all I was pretty impressed with the attitudes of both gentlemen and they way they handled themselves. I wasn't obtuse or argumentative and made sure that both of parties knew I wasn't a danger, and they responded with clear respect and professionalism and were cordial for the whole encounter.

welcome to the forum and thanks for your service as well as sharing your interaction w/your nice community LEs.

while your actions fit exactly how the nice LEs wish all citizens would react to their stops ~ warranted or responding to just a plain fishing expeditions.

i have no qualms whatsoever against a local resident calling about a vehicle in the neighbourhood, however, two nice LEs show up? musta been a slow night in the community!

one would presume, drive by to get plate number & visually check you out, if their computers are working and no wants/warrants flash and again if everything checks out, they should have moved on...

LE compliance on the side of the road is imperative but to not even question them about their rational for their fishing expedition is a different matter.

by the way, can i take & handle your firearm from you...don't move or flinch, my buddy has his hand on his service gun and is watching you very carefully...

and...damn sorry bout that, we'll get ems out here to look at the wound as i didn't realize or know there was no safety or the other quarks assocated with your carry firearm!!!

glad you are pleased you met new friends and do not see how lucky you are you were not injuried or how badly you were violated ~ and they didn't have to buy you dinner, either!

All that for sitting in your car talking on the phone? Maybe they would have preferred you were in the express lanes on I-15 doing 80 mph while on the phone?

Sorry, not awesome. Disgusting! I talk to our local police officers all the time while open carrying and not once has anyone even mentioned removing my weapon from the holster. Guess I'll stay out of Vegas.

Not to hammer on you on your first post, but what crime were they suspecting you of committing?

Discomforting mopery.

Quiet side streets adjacent to windowless building walls is where victimless crimes are committed.



A quiet Southern town of my acquaint has the Unemployment Tree at the end of a half-mile long dirt road. Park there and a cop, maybe UC, will be along to see what's up and who else shows up.

When I was shown the Unemployment Tree, I was riding in a white 15-passenger van with town logo, loaded with old whites with two uniformed cops in front. A sub-teen on a BMX rode up offering to get us what ever we wanted.

I keep forgetting that making someone uncomfortable is a crime these days.

One guy, one car, I see no need for all this. Not sure if Nevada has a must inform law or not? I think I'd be getting the window fixed and just stay in my car. I'm not so naive to not realize what sometimes happens, but given the details as stated, the LE response was way overboard. Victim was helpful, acquiesced, and apparently even somewhat initiated the response.

what is a 'disabled verterans id' ? (this id card ~ The VA identification card will allow Veterans to demonstrate proof of service for discounts at private restaurants and businesses.)

if it is the same card, why would you show it to the nice LEs ?

I don't think that you are a Wisconsin newbie.

Ok, posted before I read a few comments up.

Went to site, a few posts. Most advocating and commending compliance. One not so much. Maybe "compliance" is the wrong word, as I am not advocating non compliance so much as wondering why there was interaction at all?

My biggest issue with the OP is that he seems to be OK with what happened, and thinks the LEOs did a great job.

Todd C wanted to put it on the cops but he was properly charged, "The person has been convicted of a crime elsewhere that would be a felony if committed in this state." There does not appear to be any recognition of foreign expungement in Wisconsin Statutes. Todd C confused Form 4473 Question 11.c and its instructions that do recognize expungement.

mem serves, the bloke popped off his story, with extraneous personal commentary regarding the police and was advised by numerous forum members to seek legal counsel and to either remove extranous commentary or take down his post.

then several posts later the bloke advised he had retained legal counsel and yet was still posting about his adventure.

your post pointed out the thread was gone...guess under advice of counsel the bloke finally listened...

From the way Officer 2 described it, they had received more than one call reporting a suspicious person in a vehicle acting in a way that was making people in the neighborhood feel uncomfortable.

They pulled my sidearm (Sig P239) from my holster (Fobus Paddle/roto holster), Officer 2 kept his finger off the trigger and placed it on the hood. Officer 1 pulled my leatherman from the pocket on the opposite side. While I understand some feel my rights were being violated, I also understand about the Officers needing to do things for their own safety (again Dad's a LEO, I'd rather he disarmed someone at a stop to ensure he made it home at the end of the day rather than to trust they are a good person and turn out they aren't and I lose my Dad), in the situation I was in I was more concerned about making sure all 3 parties involved were comfortable.

Sometimes its easier to have a conversation and diffuse a tense situation if you show you are non-threatening and are a little compliant with the authorities. I'm not saying give up your rights, but bend a little so they bend a little... I've been the "LEO" Enforcing Pat Downs, Vehicle Checks, cuffing suspects, etc in Iraq as part of a QRF Team for convoys, I've officially seen both sides of the coin. I've also seen what happens when someone is not compliant and I've seen when someone is compliant. It lowers a lot of tensions and lessens the risk of hostile engagement if you work with LEO's and not against them.

I could have chosen to challenge them every step of the way, and to be belligerent about my rights, could have made a huge scene where more officers are called in and more arguing about my rights ensued.
I chose to diffuse an already tense situation where I had 2 patrol cars roll up, 2 officers at 10 and 2 without crossed lines of fire, and we ended on a very respectable and cordial note. They did their job well, everyone was safe, they flat out told me I wasn't in any violations of any laws, and we all shook hands at the end of the meeting.

Again, I have LEO's in my family and I've been in similar positions as what these two gentleman walked into lastnight. A car with Pro2A stickers, Veteran Plates, parked on the side of the road - you have no idea whats going on could be a situation where a veteran decided to be one of the "22" and you just rolled up on it or it could be someone about to do some bad stuff... I can honestly say I would have handled the situation in a very similar fashion had I been in their position.

Not the same card as what you googled. Its another form of Identification, and my NV License is a "Real ID" and it does say "Veteran" on it.
My wallet is pretty thin thanks, has 2 forms of ID, Gym Card, Costco Card, Insurance Card, Debt Card, AMC Stubs card and a $2.00 bill... thats it... I don't carry credit cards, and I don't really carry cash.

I had been sitting for a while, between the 2 conversations I had catching up with people I haven't spoken with in almost 2 years each, I had been parked for more than 2 hours... (Tech Guys from the Silicon Valley in CA. 2 years is like 4 job changes between them, new kid, and other stuff).

Apparently a white guy in a predominately not white neighborhood being parked on the side of the road, not in-front of anyone's house is suspicious to the neighbors.

Yeah window is on the list of repairs... Spent over 1k on the car in the last 2 weeks, slowly getting to the window.

I'm ok with the interaction because I have LEO in the family and I've been in similar positions as these LEO and they handled it the same way I or my family would have handled it. Even called my Dad to talk about it and he commended me on how I handled it, he is a very Pro2A (for everyone) LEO in California but he also understands the safety for all in these kind of situations.

I re-read the OP. Two cops in two vehicles is force majeure and arguably an arrest. OPie did not say, but it is likely that they were tactically positioned.

For newbies, the victim not feeling free to leave is a definition of arrest.

Yes they were at 10 - 2, No weapons drawn, not once did they pat me down nor did they ever say I was under arrest. I never once felt I was under arrest or that I was being detained. They approached me, I allowed them to disarm me, and we had a cordial conversation after that. We shook hands, thanked eachother for our service, and went about our evenings.

I asked the op if he would share this. I believe opencarry.org has some of the most knowledgeable real life experienced, legal aware gun owners of several other pro gun sites I am on. I believe this is a good thread of conversation. One can reply to such postings with learning info and opinions to encourage a OCer to better represents the upstanding in the know OCing group or chase them off to become another brain dead OCer creating negative attention to the pro gun group.
I believe the OP did well he went home with his gun, no fines. Compliance is in my opinion the number one mission with such encounter. Recording or making mental notes of LEOs actions, time, location, names, wrong doing if able to have available if one decided later to make a formal complaint. I understand the compliance question, however once the encounter has started I am of the opinion regardless of the legalities of the stop one only has 100% control over one person. We cannot control the LEOs however; we can help direct their actions by how we control ourselves.
A lot of good info on this issue to learn from and great for the new to NV OCing. Pointing out aspects of LEOs actions that could be the overstepping of their authority.

I would suggest you have that car window fixed and also invest in a video recorder for both yourself and vehicle.
Please don't be naive in thinking, that every encounter with LEO"S shall go so well..

Great for you on all fronts.. But please consider the video recorder and camera , both on your person and your property thereof..
