From a web search: "Police said the incident began Sunday shortly after the restaurant had closed. A man approached two customers before pulling out a gun, resulting in a shootout that left the suspect dead."

A poorly written blurb and headline to this story, but you'll get the idea:
"Dallas police are investigating a deadly gunfight at a N. Dallas Benihana. Police say two people were leaving the restaurant when they were approached by a man. That man asked for a lighter, then pulled a mask over his head and pulled a gun from his waistband. One of the customers pulled a gun of his own and opened fire. Both men were shot, the robber was killed."

First thing that comes to mind is to wonder exactly how much time was lost bringing the customer's gun from CC and to getting the shot off. Even a second makes a difference.

My first question is: What might have happened had the victims been unarmed and defenseless without any gun at all?

Some (hoplophobes) would argue that a mere robbery might have just been a loss of property with no loss of life or injury had the victims not "escalated". I would argue it is also entirely possible the bad guy decides he doesn't need witnesses, or doesn't like the way someone looked at him, etc, and we end up with two dead, innocent victims, and violent criminal loose on the street. I will always remember the murder of a classmate in 1992 at college. Yngve K. Raustein, from Norway, was stabbed to death on a sidewalk outside college during a "knockdown" "game" perpetuated against him and two other students. Criminals sucker punched the students and demanded wallets. Raustein was a tad too slow retrieving his wallet and was stabbed through the heart.

Good men ought to be free to defend themselves. A man who will take a wallet by force might just take a life for no good reason.

My second question is whether OCing and/or better SA might have discouraged or prevented this crime. Proper SA allows a concealed gun to be as accessible as an OCd gun or even in hand in most cases. An OCd gun--if noticed by the bad guy--might have dissuaded the criminal from ever reaching for his gun.

I wish the victim a full and speedy recovery.

It's at a Benihana and the perp only got shot? Oh - the victims were customers. That explains why the [alleged] perp was not filleted and then bounced around with a spatula.

[Alleged] perp asked for a light and then pulled out his mask and declared a mugging? *facepalm* I have a feeling this stunning mental work may have contributed to the sudden onset of catastrophic fluid and pneumatic pressure failure.

Glad to hear the Good Guy is expected to survive.

I thought Texas had fixed that restaurant GFZ nonsense. Or is it still in place for places that serve booze? Or did Benihana put up a 30.06 sign?

No 30.06 last time I was there, else the victim would have been unarmed. They are also not listed on the texas3006.com web as having a 30.06 sign, but this is hit or miss.
The service of alcohol does not come into the equation unless the establishment derives at least 51% of revenue from alcoholic beverages, and then only if it is properly posted (the sign has a large, red "51" watermark under the text.) And there is no way that applies at a place where the food is that expensive. The state commission tells you which sign (blue or red) to post. Blue says carry by unlicensed persons in prohibited. Red has the 51 and says all carry of firearms is prohibited, IIRC. They do have a dark parking lot and are deep in a business area with not much else nearby that is active at night.

I heard on the radio the guy was leaving Benihana after dinner on his way to his car in the open parking lot. This restaurant is in a business/hotel area next to freeway - no seedy apartments on that side. Not an area you would expect a carjacking.

I live in the neighborhood NW of Coit/LBJ. Not a bad neighborhood. Majority of the crime comes from the hotels and apartments around (like the ones on Maham Rd, really). They come to the good neighborhoods to steal. The area around Benihana is business, with nicer, newer apartments to the south. If one is loitering in that area, it is not an accident or someone just passing through.
