“I was detained by Portland PD officer J McDonald on 26MAY2012. He detains me without suspicion of any criminal activity in violation of Delaware v Prouse. He admits his sole reason for stopping me is my legally carried firearm in violation of US v DeBerry. He seizes my weapon with no reasonable suspicion that I’ve committed a crime in violation of Terry v Ohio. He demands my ID without reasonable suspicion in violation of Hiibel v Nevada.”

In the video the officer points the OCers own loaded gun at the man.
In my opinion the man handled the illegal detention extremely well !!!
When the man started citing case law the cop backed down.

Guilty until proven innocent.

The officer's first and worst mistake, I think, was not asking those who were reporting a man with a gun to describe the man's behavior. It would be obvious that he was not threatening anyone. The officer repeatedly said the callers said that they saw a man with a gun walking down the street.

Secondly, when the officer did get on site, he didn't take the time to observe this man's behavior before confronting him. Man has a gun, is this a dangerous situation or a law-abiding citizen? You know, there's a gun involved. I think the officer already knew that this man wasn't breaking any laws, but decided to push the situation.

But this was Portland where there is a rabid anti-gun attitude. Law abiding citizens are guilty until they prove themselves innocent. It's important to know the law and legal precedence like this man (and the officer obviously) knew.

Ooops. I did look around on the Maine threads to see if it was already discussed, but I guess I missed it.

Still, you did an outstanding job in handling the situation and I think the video is timeless and highly educational for all.
