Your Rights

I do not always open carry because I like the tactical advantage. I have OC'd many times in SB and Mishawaka and anywhere I feel like carrying. Never had a problem. I am also a LEO and every time I encounter a person OC'ing, in or out of uniform, I thank them for exercising their rights! It is our right in Indiana to carry within the boundries of the law. Exercise your rights!

I did take time to read the post on open carry vs. concealed carry and found it very interesting. Some excellent points are raised. I'm going to absorb it a little more before sharing my thoughts. Great Piece!

Fantastic! :D Watch out for ATM. His logic will get you to OC more. :D

I am thinking this a good story. Those of you who have been OC for a long time may not think its a big deal, but for me it was good.

My wife and I were out running errands this morning.

Stop 1. We spent some time shopping at Kohl's. We were there for about 45 minutes. No problem at all, no comments at all, just a few passing glances.

Stop 2. Then we went to Meijer's, a large grocery store, there's several of them here in NW Indiana. Again, a few passing glances. I spent some time looking at voice recorders and was assisted most of the time by a female employee. She didn't seem phased in the least. I ended up purchasing a Sony ICD-PX312. Seems to work great.

Stop 3. This is the best part. My wife needed new battery in her wrist watch. We could have had it done at Kohl's but the last time I let them adjust the band on my watch they scratched the watch. So this time we went to a high-end jewlery story. They always have an off-duty policeman from one of the local PDs working security there, he has his own desk just inside the store entrance. They don't wear their duty uniform, but typically wear a shirt with their department's logo on it, and their badge. This morning the officer working security was wearing a Sergeant’s badge. I couldn't tell which PD he was from, but am guessing it was eiher Highland or Shererville. I would say he was a pretty tough looking ol' bird. I walked past him with my right side and holstered 45 acp facing him. I noticed him glance at my piece, then we made eye contact and all he said to me was "good morning".

I love Indiana!

FWPD vs ACSD

Was stopped at Southgate Kroger by an Allen County Reserve Deputy. He asked why I was open carrying and my response was "I am a Marine and have fought to protect my rights to open carry". He was not happy and informed me that I had to conceal my weapon. I told him that I have a LTCH permit, not a concealed handgun carry permit. He said that Indiana law says it had to be concealed. I informed him that no where on my LTCH does it state that my handgun had to be concealed. He then asked to see my weapon. I informed him that I did not consent to a search of my person as I had done nothing illegal. He ended up calling a supervisor on his radio and I could overhear some of the conversation. The supervisor told him that I can indeed OC and that he can not search my person or inspect my weapon unless I am suspected of a crime. As soon as the supervisor said this the deputy turned to me and said "Have a nice day sir". I seem to only have problems with ACRD's. The FWPD has stopped me before but it has always been professional. Mostly asking if I have a permit, what kind of firearm I carry and if I was in the military. FWPD knows the law but apparently the Sheriff's department does not. I have been OC'ing for a few years now and have only had maybe a handful of encounters like the one at Kroger.

A better response than "It doesn't say concealed on my permit" would be "Indiana does not distinguish between open or concealed carry in the Indiana Code."
